spoke to dealer in person who contacted factory in europe was told that the factory would be sending an e-mail to explain their view ,have not received copy of this yet

I am looking for opinions on the following situation. I purchased a 150mm travell am bike in November 2012 I ride only in Tokai mainly on the downhill trail but only doing the smaller jumps .In March 2013 the left chainstay snapped where the rear brake bracket is welded on. This was replaced by the dealer under warranty In july the replaced chainstay cracked in the same place now the dealer has informed me that the factory will not replace it as I must be riding the bike beyond its capabilities . I would like opinions on the above situation I cannot name dealer and make yet as this is still a legal matter
