You will be hard pressed to fight the claim. I speak from experience. Read the back of the waybill, all the terms and conditions will be printed there.

 

If you didn't take insurance, its my opinion you really have no chance, except to appeal to their conscience, and perhaps they will come to the party.

 

Our freighter did not, but the value was high, for a grand or two they may offer a settlement, thats the best you can hope for I think.

 

It is true the courier will usually have a small limited liability insurance free with the shipment (the value will be on the back of the waybill) but it will be minimal, in our case it was R50.00, which they paid,.......on a R60000.00 loss.

 

In our case we shipped a consignment of stainless steel from our associate in CT to our engineering shop in JHB. Unfortunately, contrary to our explicit instructions our associate did not tick the insurance box, the consignment went missing.

 

The freighter took no responsibility, we hired a private investigator who traced the shipment to a SS dealer in Pretoria, the guy paid R4000.00 (by cheque believe it or not) for R60000.00 worth of SS.

 

The Investigator also found out the Freighters driver had two criminal records for fraud and a pending case for unlicensed firearms. We got the police involved, they were not interested and the matter dragged on interminably.

 

Finally we took the freighting company to court, long story short, after fighting three days in court we lost, the magistrate said the freighter had clearly stated they were not liable for losses on the back of their waybill.  

 

So a loss of R60000.00 material turned into a loss of around R100000.00 after PI costs, legal fees and courts costs. 

 

Always insure, its the safest.
