That's a 2014 Evo footnut, there's no crush washer under there. The spring rod should press into the bottom of the lowers forming a seal, and there's an o-ring on the bolt as backup.

 

If it was bought new in March and it's leaking it'a a warranty issue. Take it back and the agents will repair or replace.
