I feel for the injured rider as spinal injuries are not something anyone 'deserves'

 

That said..

 

So many of the replies in this thread have already said what I would have.. Suffice to say, the first time I saw it, I watched a few people do it, decided it wasnt for me and walked over the rocks.... Whats so hard about making your own decision?

 

If it was on a flat piece of ground I would have tried it, but the rocks below put me of...

 

Im now going to build a small one in the garden in the mini bmx track for the kids and me thoughSmile

I just read the article. The family wants to sue whoever built the thing. Let's put aside the fact that the dude only has himself to blame for riding it and ask the question: Can they sue the builders? Would it hold up in court?

There is an old established principle in our law: Volenti non fit injuria

Simply put it means if you willingly participate in a dangerous activity you assume the risks associated with that activity. If there was a disclaimer present on the obstacle the injured party would have little prospect of succeeding in suing for damages.

You could just as easily fall off a bike riding down your driveway and suffer similar injury. Who do you sue then? Answer - no-one.

Man it would be cool if I could sue people for my own stupidity! I could make a living falling off my bike, drinking hot coffee, etc.

 

Hell, I could get drunk, drive home, crash my car, and sue the bar owner! Whoohoo!

I'll indulge you: What exactly are you sueing for? Assume I'm riding along and I see a cliff, or a ring of fire and I decide to ride off the cliff or thru the ring of fire. If I wanted to sue someone once they put out the fire or patch me back up, is this not tantamount to wanting to sue someone for my own stupidity?

Roman-Dutch law doesn't even require a disclaimer in the Spruit example above. It just adds weight to the argument against a lawsuit. If I play in a rugby game and decide to go for the line with ball in hand and someone called Schalk (long blond hair) tackles me the way he normally tackles, would my family be able to sue him for the multiple surgeries required to get me walking again? No.

Life has a general disclaimer built in: Take care or suffer the consequences.

thanks for that. major problem these days is all the buck-passing no one takes responsibilty for anything. am curious, cycleq, you a lawyer?

Got in touch with a builder of an obstacle and have in the past few weeks spoken to two others. These guys want nothing to do with anything on the spruit anymore.

 

Not only are people breaking their own necks, they are spoiling it for others.

 

Funny how the people complaining (this is not just on the spruit) are the guys who expect everything to be done for them. Never see the complaining type pick up a hammer and build something useful.

Pretty sure you sign an indemnity before you ride. Giba and Logwood do. Funny enough, NF doesnt have you sign anything. Maybe it's because it is government land (not too sure here).

Anytime... but there is a 'junior' BMX track near us that my son races at...

 

They even have a class for old lunatics... Join us next Saturday.....Tongue
