The driver says he did not see ME.

Please guys I need YOUR help.

FRONT WHEEL LOOKS OKAY. MY LEFT KNEE IS ALL BASHED.

RIGHT PEDAL IS SMASHED. MY RIGHT SHOULDER IS FULL OF GLASS.

REAR WHEEL IS ALL ASKEW. MY NECK LOOKS LIKE A CAMEL WITH BUMPS.

FRAME IS COVERED IN CRACKS. BODY IS FULL OF BRUISES.

I AM KNOW LOST WITHOUT MY BIKE.!!  

YES I WILL BE CONTACTING A LAWYER.

I WILL BE CYCLING AGAIN VERY SLOWLY BUT ON THE GRASS.

Some VERY generous person,  PERSONS have made some PARTS available.

It looks like , I have an offer for a BIKE or WHEELS. TILL things get FIXXED.

NOW to sort out the Paper Work. CLAIMING for this damage.

I dont understand this post.

 

You give no information about the issue, ask for help, dont reply to any questions!!,......... then post you are claiming for the damage.??

 

1)I need to claim from this IDIOT - which idiot, the driver? the company who employs the driver?

 

2)The company wants me to claim from driver. - which company?, your insurance company?, the company who employed the driver? or the company appointed insurance broker? - you need to be a lot more specific.

 

3)NOW to sort out the Paper Work. CLAIMING for this damage. - With who are you filling out paperwork to claim, your insurance, the company insurance, the drivers insurance, an attorney,claiming dierectly from the company?............there is no info frail, you need to cross your T's and dot your I's if you want advice, folks have asked questions, but you have pointedly ignored them, how do you expect advice.?

 

If you dont have insurance, "say so", if the company or driver is not insured "say so", we are all sorry to hear about your "neck that looks like a camel" (sic) BUT,it has no bearing on the issue you asked for assistance on.

Porky - on second reading - you are 100% correct - I messaged him to claim from the drivers company - and if he doesn't insure a 50k bike - then cowboys don't cry!!

Sure agreed, claim from your own insurance, and we all move on.

 

I didnt mean to be "hard" or "insensitive" to the OP, but the post go's nowhere. Too many "loose ends" to be relevant.

I do not have Insurance, My mistake.

I am speaking to a Lawyer. If I should make a claim against the Drivers

Company?

I mention Paper work meaning (Claim and Lawyer Process)

The Company refering ( the drivers Company)

If the Company / Driver has Insurance, I do not know ?

I was ASKING for advice, IF I could claim from said Comany?

Hmm, difficult frail.

 

1)If the drivers company dos NOT have insurance, I would say it will be difficult and costly to get compensation - will definately require a legal channel and you will need to drag them to court.

 

Even then, theres no guarantee of a successfull outcome. However I can guarantee there will be some hefty costs in getting them to court - you need to be sure they also have the ability to compensate you as well, otherwise, ..........well, it'll just be a waste of money.

 

2)If the company has insurance, you may be able to claim against their policy providing the insurance company considers it "the drivers fault (ie) you were in the right - thats your best hope really. If the insurance deems it your fault (ie) didnt stop at a light - they are not obliged to pay for your damages.  

 

Has the company requested the police report? One hopes you lodged the accident at the police within 24 hours, if only to cover yourself. 

 

If they havent come forward with requests for document etc, this makes me think there may be an issue here (ie) no insurance. Lets hope not and they will still come forward to discuss it.

 

Dont waste your time trying to claim from the driver, its unlikely he will have the ability to compensate you and it will just end up costing you much more in legal fees.

You MUST go after the company!!  The driver will not have the means to pay/compensate you. That will be an expensive dead end!!

AND HOW THE HELL CAN YOU AFFORD A R50k bike WITH NO INSURANCE!!  Silly boy....

After my accident, I approached a law firm who specialised in road accidents. Needless to say I was appointed a junior associate who displayed no indication that he was on my side. I was given the wrong advise and "my lawyer" basicly was feeble in court, no clue and cost me R8.500.00 for no prep work and a phone call to tell me we were due in court 45min before the set time. My advise is make sure your lawyer is interested in the case and gives it the attention it needs, otherwise you are going to loose more money. What do they say about lawyers again?Angry

Olive Boy I've got quite a different story - got hit by a car and ended up in hospital with gravel under my knee caps and too many cuts and bruises to mention.  Bike was trashed (and uninsured)  The guy that hit me was in no position to compensate me but my medical aid requested that I try and claim from RAF to cover their hospital fees.  Had a great lawyer who agreed not to charge me any fees unless they were able to get an amount greater than what was owed to the medical aid. 

 

All said and done I got enough cash out of the whole thing after paying the lawyer to buy a new bike.  It took a while but the medical aid were happy to be compensated and I was happy to be able to replace my bike - make sure that if you claim from the RAF that you get a lawyer that will only charge fees if they can get you something and if not then the work was pro bono.
