You can make a claim, no-one can stop you doing that, as to wether it will be successfull.....well that is another story.

 

Generally these types of claims are just referred to the muncipalities insurers, but there are certain things you need to ascertain before any claim will even be looked at (a)You need to prove the muncipality was aware of the pothole BEFORE you crashed into it and they had been notified with sufficient time to repair the hole or mark it a dangerous area with tape and chevrons etc, this is generally the "bug in the woodpile" because how many people do this, not many, so thats your first hurdle. (b)You second hurdle is getting it past the muncipality clerk to the insurer and back to the clerk and then to you.

 

It can be done, just depends on how effecient your muncipality is and how long you dont mind waiting, I crashed into a pothole on my way to Sabie 4 years ago, made the claim and have a file of replies and counter replies - no result yet though!!.
