@Johan: Well its even uglier now as i've filed off the paint to see if there's any cracks. There's a slight lip on the top as well. Will still have it checked out.

 

 

 

@Wannabe: I flew Kulula up and down. On the way up was when I saw it lying under hundreds of suitcases but i was only able to ride like 3 times so didn't notice the damage. I don't think i'll be flying with my bike any time soon.

 

 

 

The decision now is whether to fight Kulula for it. The bike is insured as well but everything's such a hassle

kukula won't pay out as in their view it's damaged not broken. damaged luggage is common and the airline as part of the disclaimer, does ntoaccept liability for damaged luggage. You can claim for repairs but not  a new frame because it's not broken. :( pretty crap if you ask me but thats airlines for you.

 

baggage handlers are ACSA employees so you could take it up with ACSA (airports company of SA) and claim from them.

 

The least painful route is too lodge an insurance claim after your LBS declares the frame a write-off.

 

IMTO, the frame should be ok until you have a collision with another cyclist or a motor vehicle so try not to have either. The dent looks bad enough to have created a weak spot where the frame could fold if subjected to a collision.

I've had a careful look at the disclaimer and the terms and conditions and they do pay out damages in the event of serious negligence. ACSA are indeed one of their agents but Kulula has a duty to ensure that their agents do an adequate job. I'll see how things go. At least i can still ride the bike.

I think this has come up before but a disclaimer that state no liability only works if there's no negligence on the airports side. Although it might be a bit of a headache to fight it you will get paid out in the end. First thing is to get your lbs to give you a written quote for repairs. Or claim from insurance... on or the other.

So after 2 months of waiting i finally got paid out about R2000 for the damages. Its not going to get me a new frame but at least it covers my shifter that had to be replaced. Oh well
