There is no evidence to show that they are not part of his greater scheme. It is difficult to think that they cannot know what is going on here. His name was up on the fb page for a short spell. Pictures of them all having a jolly time not so long ago. By refunding an individual is that not accepting guilt on behalf of the guilty party? Same as paying a fine is it not?

I may be mistaken but as far as I know anything legal has to be delivered and signed for. An email doesn't have any fire behind it. Wood or no wood. In order for legality, you have to have evidence the person accepted the proceedings. This is what I learnt by taking someone to the small claims court.
