Advise with Cracked frame and naked

Hi , is am wanting some people's advice.  So I found this crack on my bike and tried to claim with Naked they then replied back and said they won't insure it and claim it is wear and tear after taking it to a carbon specialist . My bike is a 2023 cube am 099 slt so it is only 3 years old and I was wondering what people recommend as how can a cracked frame be wear and tear when you can clearly see where the carbon has compressed , they are now keeping my bike . I had also taken it to my bike show who had it in for assessments and they came back recommding replacement amd how they have refused for us to see any of the report from the 2 assessments and the only thing we got back was from a third party group called Raw who basicallysaid it was due to putting my seat post in and out and that it is very normalfor bikes to do this.  Thanks
