What happens if someone else put in your celll number? will you still get charge or is the 1st sms a confirmation sms that the cell subscriber accepts the cost?

 

Good question, and I cannot answer as it depends on the company running the service.

 

But our company does not allow any of our clients to use this mechanism unless we are happy they have a proper confirmation system. One of the largest mobile products in the South Africa wanted this system, we said "Sorry!". Explained the issue, both legal and brand image damage, and they excepted. They have now implemented a far better system.

Good point, i think it should be compulsory for just such a case.

Also put in a claim at the bank as the bank misled me with the sms they sent me.  Don't know if I will be successful.  Won't know if you don't try.  Still waiting for them to get back to me.  Now I don't trust ANYBODY.Dead Very expensive lesson learned.

 

You must hammer them, lean on them, bug them

If you wait for them to follow p its gonna take a while.

Not completely to the point but how irritating are those fricking subscription ads on telly!????? Especially when you are unfortunate enough to have to suffer through a late Fri or Sat night  SABC movie.

You only have a case if the bank sent an SMS explicitly stating that the funds are available, as opposed to a mere deposit made.

The bank made me an offer to pay 50% of our loss.  I accepted, because I feel that I am partly responsible.  The sms the bank sent me did state that the funds are available, but I should have phoned before I released the goods.

Personally I think they should pay everything especially if the sms stated that the funds were available.

If the sms says that why should you phone. .  you pay for the sms. .  the information should be accurate

Well Angel, its up to you. I dont know what the sms read but if it stated the funds as being cleared then the banks notification system is not compliant. I would have taken the matter up with the banking ombudsman/FSB and  accept nothing short of 100% refund AND an apology scotty2009-06-09 02:00:00

Funny thing is, they do not take any responsibility for the sms that was sent.  The 50% refund is based on the fact that I have immediate clearance on all cheqeus deposited and they could not find any proof that I signed for this.  I have to carry the rest of the loss, because "it was my responsibility to contact the bank and find out if the money was indeed released, and should not only rely on the sms".  I didn't know any better and thought, just take the money and run.  It's better than nothing.

This is offering consumers limited protection as the reply MTs (SMS) are all WASPA compliant.Its a legal minefield here, our company is one of the industries largest WASPS and I'm kept in the loop on the legal status of our customers and their campaigns. If the law finds that MTN is percieved to be a lottery or even percieved to be competition to the national lottery, it will lead to a very interesting law suite.One of our clients went that way, legally the people trying to stop them could not until something happened and they had to shut down immediatly (nothing bad but just a legal loophole to their advantage got closed).

 

 

 

Not saying you're wrong, but Airborne doesn't seem to be a Waspa member either.

 

 

 

This is the response I received from a Waspa agent:

 

 

 

"Hi Julius - I just saw the email you sent to Ant regarding MTN. MTN, Vodacom and Cell does not fall within our jurisdiction.

 

 

 

"The company sending out the sms's on behalf of MTN is Multimedia Solutions, but they are also not a member with WASPA"
