Jamex, her being under the infuence (drugs - prescribed or not, alcohol, whatever) does not invalidate your claim! She still stays legally liable. So even if you do not want throw the law book at her, do all the steps to assist your insurance. they will do it on your behalf!

Why must you pay and claim from your insurance when it was her fault. Nail the women. You were silly not to have her taken in for test.

Wow, pleased it's only your bike that's broken. Once you've got all the dirt out of the skin put on a liberal dose of Tee Tree Oil -- going to burn but the recovery will be unbelivable!

Hard luck  there & hope you recover soon ... but ... big mistake not getting evidence and getting her tested. Seen this movie several times and been through the court cases with RAF - tomorrow the story will be that you swerved in front of the car and you smelled like liquor.

 

Maybe one of the legal people on the hub can put together a shortlist of things to do when a cyclist is hit by a car?
