She still stays legally liable. So even if you do not want throw the law book at her, do all the steps to assist your insurance. they will do it on your behalf! Hope you heal up soon! Seen this movie several times and been through the court cases with RAF - tomorrow the story will be that you swerved in front of the car and you smelled like liquor. Maybe one of the legal people on the hub can put together a shortlist of things to do when a cyclist is hit by a car?
