Please try be patient with me if this has been covered before.

Im scanning the classifieds looking for a new bike so I have been seeing this coming up a lot.

Quite a few people are saying that their 2nd hand bike would have a frame warranty.

Now my understanding on this from having looked at most manufacturers warranty policy is that the warranty is only offered to the *original* purchaser and that it is not transferable.

 

I have seen people saying "just take it to x shop and they will sort it out" but I dont believe that when it came down to crunch time or if there was a complication that they would sort it out.

 

So am I way off in my thinking?

Yip, you can commit fraud and let the original owner take the bike in to the dealer....but its fraud.

 

They don't have to honour this so rather purchase a secondhand bike knowing you don't have any recourse ito warranty.

If I'm not mistaken, if a trader sells a second hand bike, he is obliged under the Consumer Act to warrant that the bike will have no defects (unless he pointed them out to you) for 6months. This does not apply to private sellers.

 

Individuals on the Hub cannot state that the bike comes with a warranty, because most manufacturers do not warranty the second owner.

 

Nothing stops the individual from offering his own warranty though.

they published a very comprehensive article in the bicycling magazine about this around Feb

 

 

If you sell your bike and it becomes second hand warranty is void if you are an individual. because the default method of selling is "voetstoots" as is, unless agreed otherwise

 

 

If however you are a bicycle shop, the whole consumer act comes into play and then its not "voetstoots" unless they specifically state it is.

Help me understand a little better Rouxtjie - is it still fraud whereby the original owner hands you the original purchase receipts and says warranty is yours as such? Cause I have noticed that in the classifieds as well. Take it it is fraud as the lbs must have your personal details down, so even in the case of having original purchase documents the warranty falls away?

True. does not transfer and the shop would be committing fraud by pushing a warranty thru by hook or by crook...and if the warranties manager is sharp (like Specialized, or PowerTap - they have a very in depth serial number database and will tell you who bought it and when) then the shop will come unstuck by trying...

Yes, the original invoice should have the original purchasers name and details on it and thus you are not entitled to warranty even with such documents...

Thanks for the replies. So the warranty doesnt transfer which is how I thought it works.

I always expected that a 2nd hand bike has no warranty even if it is a few weeks old!
