Is daar enige feite tot dien effek dat die bestuurder van die voertuig die eienaar/lid van die besigheid is of 'n werknemer is van die besigheid wie in uitvoering van sy pligte teenoor die besigheid opgetree het toe die voorval plaasgevind het?  Dit wil voorkom met die feite op hande asof die bestuurder van die voertuig laakbaar opgetree het.  Dit beteken egter nie die besigheid het insgelyks laakbaar opgetree of is aanspreeklik nie.  Daar moet gevolglik met versigtigheid gehandel word om nie sonder meer besighede te boikot en vulgere name te noem sonder dat al die feite nie duidelik blyk nie.

This morning he phoned the owner to see if they can settle for all damages without a civil law suite(was told by attorney that this seems the only way). Oke had major attitude and said he is not paying anybody anything he is not interested and put the phone down.

What I am saying is that we as cyclists should start a fund in order to assist with cycling incident legal fees. I stand to be corrected but as far as I know PPA is does not have anything in place to assist cyclists. In Leenderts case - his bike was insured. Note that he will not be doing this for personal gain.

Let me restate  what I said in a previous thread.  I'll join such a fund without hesitation, if it is properly managed.

Maybe we can get hubber laywers, like kkkcycle, to be the contracted attorneys and they do it either pro bono or a reduced fee as part of their contribution to the fund/network.

 

It can be linked to and managed from within theHUB either as an NGO or a trust.

 

This is something that we should seriously consider, but need to apply our minds properly beforehand.

Was the incident reported to the police? Isn't this a hit and run? Correct me if I am wrong.

 

Was reported at police. Not hit and run driver did stop.

Was reported at police. Not hit and run driver did stop.

I presume you took down the details of the driver and is in a position to confirm whether the driver is one and the same person as the person in the pic submitted by SCHWINN LOVER

Please remember I never said the person in the picture was the driver, as stated before the details I posted were for a company with the same name mentioned by the OP and according to the website said image is of the owner.

Driver is not the same person as in the pic, details of the driver was taken. As Schwinn Lover said - it was taken from the website - http://www.jrwendys.co.za/contact.php

Leendert is willing to prove a point that cyclists safety needs to be taken seriously but will need some help in funding as a civil law suit would cost fair bit of money. 

                                             

If anybody have any advice contact Leendert  - 082 778 0212

 

Maybe we need to start that talked about legal aid fund to assist cyclists and families of cyclists with legal costs

 

Leendert would be able to recover damages to his bicycle up to an amount of R15 000,00 without incurring any Legal Cost if he institutes an action in the Smalls Claim Court.  See http://www.justice.gov.za/scc/scc.htm

Cyclist are getting knocked over left right and center, shopping centers are being robbed daily now in Cape Town, what the hell is going on.

 

We only used to hear s&*t like this from Jo'burg!! Did the assholes moved down all together??  :devil:  :devil:
