Not sure you guys read the thread properly...he got the run around after dibs'ing a sale item. this has been debated before ad nauseum....and essentially there's no once size fits all concept of what's acceptable to all. I'm a free market guy, and until you're there cash in hand the deal is not done.

 

I disagree, dirtypot had agreed a sale and arranged to inspect and buy if happy with what he saw... that was not a dibs, it was a verbal contract.

 

 

 

 

There was an agreement between Dirtypot and the seller to do the 4k deal at the Oak Valley 24hr.

It's the ethics that I have a problem with.  Obviously there was no firm agreement in place, but this just reeks of greed.

No. If you offer a product for sale at RX and I unconditionally accept it at that price, there is a "meeting of the minds". Contract formed.

 

Which is why if I go to a shop and they screw up the pricetag amd I show up at the till with legal tender they have to sell it to me. At that price.

 

Legally that's completely untrue.

 

The advertised price on the "offer" is an intention to do business. By taking the item to the till you are making the offer at the price they recommend and they can still reject the offer if they choose.

 

They only have to give you goods at the price on the price tag since the CPA come into effect. Its also recommended because of customer relations. But in law of contract they do not.

Seems you have not read the thread either, Dirtypot said he would buy it, the seller said he could not meet that night, but could meet after the mtb race which both were doing.  The buyer was coming with cash and if he was happy after inspection would take the bike there and then... this is not a dib that he might buy it sometime in the future!!  

 

The buyer agreed to the sale and arranged to meet and bring cash... so in your wonderful world, even if a buyer was coming with cash...  it seems you are all for free market... at that even if the guy was on his way to you and someone came with a better offer and got there before to give you cash you would accept it??

Is this not the difference between your ethics and what constitutes a final sale?

 

I've bought and sold a lot of stuff on classifieds and in the case of selling things I've had plenty of instances where I've had someone promise to buy something and then back-out at the last minute. Time, place, price, etc. all arranged and then an hour before buyer pulls out with an excuse like "I found a better deal". So imo — having experienced both sides of a failed deal multiple times — until the money is in hand and goods have been exchanged (assuming no contract), the sale hasn't been concluded.

look it doesn't really matter but you've made about 10 assumptions here in 2 paragraphs - most of them wrong. I didn't see any indication that any agreement was made. This is textbook DIBS.

 

DIBS doesn't always work, but obviously you're a chop if you renege on the guy who DIBS it. But, there's no rules against being a chop. All you can really do to a chop is rate them badly.

 

You can assume my actions all you want.
