One of the most insidious sociological epidemics sweeping the United States, and really the world, in our day in age is the lack of personal responsibility. These days, whenever something goes wrong, most victims are immediately on the lookout for who to blame. Not only that, but they often look for any angle possible for a lawsuit. Get handicapped in an accident of some sort? Nowadays that’s the ticket to a multi-million dollar settlement and a life of work-free handicapped boredom.

The "who's liable?" thread was a great example - a dude in cycling shoes slipped and broke something and the majority of the posts were "you can sue them!" or "it's not your fault".

 

Silly example but indicative of the "americanisation" of South Africa. Nothing is anyone's fault anymore. I have even coined a term for it "collective non responsibility".

you must see the fantastic clauses being put into contracts nowadays to try and avoid any form of liability.

It is crazy the things that businesses have to protect themselves from.

The issue (lack of pers resp) is intimately tied to the American legal principal of no-fault liability.

 

in other words, the manufacturer/seller/provider of services is liable for damages suffered by the consumer EVEN IF NO NEGLIGENCE is present on its part.

 

In short, the provider of the goods/service must be the stupid twat that hurt himself without the twat having to prove that the provider was in any was negligent or responsible for the damages suffered.

 

The Consumer Protection Act achieves a similar goal in SA.

 

Combined with FREE LAWYERS (contingency basis, ie you only pay of you win), it's a recipe for huge amounts of litigation and lack of personal accountability on an unprecedented scale.
