It happened fairly late into the race. Last week of the race iirc. Thevenet ended up the victor as Merckx couldn't recover well enough from the after effects of the punch. So ASO knows what could happen. They are essentially choosing to turn a blind eye as they seem to be of the belief that this sort of incident is the exception and not the rule.
