Accident..What are my options? Legal or otherwise!

Well it has been two weeks after I submitted all the relevant documentation for a 3rd Party Liability claim to Outsurance and I am yet to hear a word back! And I have sent a few mails requesting feedback, all which remains completely unanswered. I will give it a few more days then start asking how I can escalate within Outsurance. Sure I assume this can take more than two weeks to process, but a  simple acknowledgment at least is the minimum one can expect as some form of feedback. Even if it says.."Yes we are aware, and yes we still processing it, so back off!" Right now I am met with silence. But they say patience is a virtue..right?

Like the way patience is a virtue when your installment comes off every month, phone those idiots back and put pressure on them, dont sit around waiting for what most likely will be a negative response from them cause you probably forgot to wear chamois cream or something sad like that.

Your claim is not with outsurance, it's with the driver. Send him a letter stating what and why you are are holding him liable, and give him a time frame to comply. It's up to him to claim from his insurer to cover his liability. This way if outsurance don't pay or part pay the liability still sits with him and you can proceed to recover from him in court.

Not an expert but would imagine that an accident that occurs between an insured party and an uninsured party will end up with the insured party having his vehicles damage repaired by his insurance company,

Do not think there is an obligation for the insured or his insurance company to pay for any damages to any other parties.

 

I think the OP (uninsured) would have to make a legal claim against the insured driver.

( which he will refer to his insurance company to resolve, and imagine they will not pay up)

 

Bottom line, if you are not insured then you will likely have to buy a replacement bike yourself.
