Funny that

Brandon only sent the email to FP after the issue came to light on the Hub.

From my understanding this was not his view before it was discussed on the hub.

 

Sorry to say

that Brandon (Probike) is not as honorable as he makes himself out to be. Look

at the email below that he send to another competitor after they did a price /

spec comparison on numerous brands in the industry. I am aware of other similar

threats on numerous other suppliers. Talk about anti-competitive!

Gotta love these forums where you can hide behind a nickname and post e-mails who were not even sent to you, unless you are actually Brandon, Dave or Zoon?!?

 

I personally prefer to apply mud to my own face by actually riding in it and not posting BS about myself, but if thats how you roll.. enjoy!

Secondly, threatening a competitor with selling goods at below cost to wipe him out may amount to something like abuse of dominant market position - I sense there are some lawyers posting on this thread - Anyone like to clarify?

 

 

 

If this email is authentic I'm sure the CC would like a copy. Clearly Unicycle is scared of retribution and that's why he is posting anonymous. From the wording of the email it sure looks like he has reason to be scared.

Without the information present in the email that Brandon are Zoon are refering too it's difficult to understand the conversation.

 

To me it looks like one company did a comparison chart against a competitor but did not represent that competitors product spec correctly and then distributed this comparison chart to retailers when both companies COMPETE in the same market. That could be viewed as false advertising which is not exactly legal either...

 

this seems to be a big compnay flexing it's muscle and threatening to start a price war (which would be nice for consumers) in order to make his competitor hurt (thats competition..)

 

Perhaps not a very nice thing to say but it's certainly not Anti-Competitive as it's one distributor facing off against another. the consumer wins.

 

Brandon may as well have said, "Zoon, I don't like you, you smell bad, I'm buying your company."

 

 

lastly, I don't think Brandon made himself out to be honourable by posting his companies stance on the alledged price fixing fiasco. He merely made a position statement. that has little to do with integrity, and a lot to do with Probikes stand on competition amongst it's retailers.

Thanks GoLefty - I suppose the anti-competitive behavior in a price war would be where you intend selling below cost to wipe out a competitor and thereafter raise prices to higher than it was before?

thats not anti competitive because the competition still has the CHOICE not to lower their prices in response.

 

it could be seen as abuse of a dominant position.

 

Or if Brandon goes to his retailers and tells them not to stock Silverback.

 

that would be anti competitive.

 

A price war is not really anti competitive as long as you are not a dominant market position. 

I have not market share data so don't know the answer to that
