So coming home from university I was recently fined for not having an emergency triangle in my car. I have a Toyota Tazz that was registered in 2004. From what I gather, it is only compulsory in all cars registered after 2006/7. Does anyone know what the actual new law is? And if they fined me illegally what do I have to do to get it revoked?

I do understand that it is an important thing to have, I have consequently purchased triangles for my car. But with very little press coverage of the new law it will likely become a money making scheme preying on people with old cars that don't come with the triangles.

Go see the Prosecutor dealing with Traffic Offences at the Magistrates Court in whose jurisdiction the fine was issued. I'm under correction, but triangles are only compulsory for new vehicles (or at least a year or two old).

If you were wrongfully fined, the fine will be cancelled.

The Act that deals with warning triangles being compulsory specifically states the definition of a vehicle for the purposes of this piece of legislation excludes vehicles first registered before 1 January 2006 (I think) and ambulances. A colleague of mine also got a fine, and he has written to the prosecutor in Jhb to have the fine squashed. See www.greedfines.co.za for the piece of legislation to refer to in your letter/argument before the prosecutor.

We either have metro ignorant of the law, or they really are a money making machine (maybe both?).

1 July 2006.

Here's the copy of the relevant section of the Act:

It's an illegal fine issued as a result of Metro's ignorance and pig-headedness.
