I understand you can claim from the local council if you damage your car's rims or suspension in a pothole. Can you do the same for your bicycle wheels?

At Cresta Wheelers there was a tandem couple that had a successful claim for a set of wheels from the council. this was years ago before the the council workers filled their pockets first.

If you're riding on the road, most likely, however, if you're riding on the gravel section next to the road, probably not

 

It would depend if it was based on someones incompetance or not - like a man made hole that is in the wrong place with no warning :D

the problem with that is it becomes difficult to prove who put the hole there in the first place

Well having spoken to a few farmers, their take on it is the same, they will get sued cause even though a person wrongfully gained access to their private land, and had an accident.

Not been in the situation. I know personally if it was my fault then no, but if someone dug a trench and did not put signs up or demarcate the area I would.

 

That would apply to the side of the road, not the farmer. The one farmer that told me a story of how a guy got hit by a tractor while croosing his land and sued the farmer for his broken bike, hospital bills & emotinal distress.

1.You trespass and moer into trench....will you sue the farmer?

2.You ask for permission...still moer into the hole...sue the farmer because he didn't demarcate the area

 

 

I don't know man, leaves a *** taste in my mouth...cowboys dont cry, you wanted to ride the trail, don't blame the farmer for your lack of talent.

I am sure you can but i claimed for a damaged car Mag,tyre and suspension and it took 8 years before they paid me out.Claim was For R14000 and they paid R1000.

 

I don't think it would be worth it though.

If I could have sued for every time I had fallen because I wasn't paying attention, ran out of talent or was just simply unlucky I'd be a rich man by now :)

Its happened to a farmer in the Hluwewe area, although private land is not fenced off, so along comes the rider and gets hit by a tractor - The rider succesfully sued.

I think even if you had permission and something went wrong, you could possibly sue the person for neglisting to tell you of the hole or the fact he may have a tractor on his farm

 

I agree it leaves a *** taste in the mouth, but is the way the world is nowdays. No such thing a just a accident.

 

Just a disclaimer - I agree people need to take more responisibilty for their actions.

Correct. Common law 3rd party liability created through negligence in not doing their work properly.

It's a very slippery slope towards becoming a sue-all society with a complete lack of responsibility for self-preservation. Sad and pathetic in the true sense of the word (I'm saying this because people incorrectly use the term "pathetic" on a daily basis).

Exactly...you would think it's common sense

 

I also think people put themselves into a financial mess because they didn't have personal / medical / life / disability insurance and is looking for a fall-guy so to speak, cause heaven forbid it's their skills that might be questionable.

 

I think chopper says it best....harden the F*** up
