So I had my first cycling accident today. Ironically, it was on the road.

 

Heading down Bryanston drive past Riverside shopping centre towards the Spruit, a car heading up from the circle was turning right into the centre as I was heading down (a car heading in the same direction as me had stopped with a gap to let him through). Was not able to stop in time as he turned in front of me and connected with the front right. Somersaulted over the car, head first and then onto my back. All I can say is thank goodness for the helmet and backpack.

 

Will be going to the cop shop just now to open a case. I wanted to ask some advice from hubbers with regards to the situation - the driver was not able to see me, and I was probably going a little quicker than I should have, although I did have right of way (correct me if I'm wrong?). I don't have bike insurance. What should I do with regards to damage to the bike? Foot the bill myself or take it up with his insurance? Any other advice for what I need to do?

And the less important aspect... equipment damage. Less than 200km on the rims :( mew.

I know Giant. I've been threatening to sit down with a certain hubber / broker for months to get it sorted. Karma's just given me incentive.

Ouch dude, just glad you ok and didnt get seriously hurt. count your blessing as it could have been much worse.

I was in a similar situations as you've experienced last month. (and sadly, i'd to written-off my bike)

 

you'll need to get all the details of the other party (ID number, driver licence number, vehicle licence plate and registration number that's on the disc, home address and contact number),

 

open a case in the police stations ASAP, and get yourself checked up by a physician (GP for the physical damage that you've sustained)

 

if your bike is not insured, the best that you can do is to get quote of the damage of the bike and send it to the driver that crashed into you.

agree try your luck with the other party's insurance all I can think of or pay for the damages yourself.

Thanks stig. that's what I had in mind.

 

The funniest part of it all was that he got out of his car and first response is "It's ok, I'm not going to sue you for this". took a deep breath and took down his details with little conversation. If there was any question of me footing the bill myself, his arrogance is probably the only thing bugging about the incident.

 

My gf was 3m in front of me in the traffic. Big thank you to you babe for staying calm. sorry about the scare.

He should have (at least) third party insurance - try not to be a hard-ass and ask him to help you out - poor commuter can't afford a car etcetera. He may end up paying more for his insurance after a claim so try and see it from his pov as well ... I wouldn't like to try and lay blame as to who was wrong / right, but I can tell you that I absolutely HATE it when dipshits stop like that (to let other cars through the traffic - it's always a mess waiting to happen)

Happened to me at exactly the same spot, managed to apply the brakes in time though and lightly nudged the bakkie's bonnet. That's why I stay off Bryanston and go down that road running parallel.

 

Who was to blame can get very messy. I am merely playing devils advocate here but were you slotted in behind a car as you would have been had you been in a car yourself - if so you have a case. However if you were travelling past the cars on the left he would argue that you are to blame i.e. if the car in front of you stops you must stop, not go round it on the left hand side. Insurance Co will no doubt argue contributory negligence - was the car damaged i.e. any dents. If so he may counterclaim!

Thanks H. Definitely came off lightly there. I know you were somehow involved... maybe cos I was trying to ride at your pace.

 

Phoned the oke last night, "it wasn't my fault, i take no responsibility for the matter". This is gonna be fun.....

You're right, this is going to be a struggle. I had a similar experience last year ( came off easier than you though ).

Driver was very apolagetic and promised to cover any costs.

When he realised the value involved, he changed his tune.

In your case, the driver already sees himself as fault free.
