Adding to this - if the seller sold to the higher bidder after the agreement had come into play (acceptance of the deposit subject to terms) then the initial buyer would be within his rights to demand that the seller provide him with another bike at the same price, in the same condition, regardless of the cost to the seller. That's if he decided to take it to the small claims court, and if the seller disputed the claims, had sufficient evidence in the form of telephone recordings and / or text / email messages etc.
  3. bear in mind that the bond repayment on a R 3m home is in the region of R 30 - R 35k per month... 4 bed, 2 bath, reasonable space in that area - that's about average. Our family though - total expenses R 40k per month. That's with a house that has a R 500k bond and then all the other things on top of that. If the bond were larger, we'd easily be spending north of R 60k per month..
  4. Then have a look at the difference between the rentals and property finance pricing. No use going through the effort of refinancing an asset if the rental prices would be 20% lower than the repayments on the mortgage...

As soon as you accepted the initial offer, despite the reduced purchase price and the other buyer offering you more, you have entered into a verbal contract of sale and as such you are being highly unethical by selling to buyer 2. The correct way to do it would be to say to buyer 1 that he has until x time to transfer the deposit, and if the funds are not transferred by that time then the sale agreement is rendered bull and void. In the meantime you tell buyer 2 that you have a buyer at the moment but if the deposit has not reached you by x time then he can take it. In this case you must hold the goods from the time you agree to the sale, and have received either proof of deposit or the actual funds. You must also take POP as intention and proof of transfer of funds and hold until you receive the rest of the funds. Buyer must not attempt to collect the goods until full and final payment has been made and has cleared into your account. That's the ethical way.

  12. Well, the only dead Stark is Ned. So far... Catelyn comes back as Lady Stoneheart (though I dunno if you could call her a Stark still) and Jon is still there. So the only dead starks are the old Starks...
  13. At the end of S4 that was as far as his storyline had gone in the books, so he hasn't continued in the series as of yet. Fly would be as part of his experience and a Warg, I'd imagine. My take is that Jon will be resurrected by the Lady Mellisandre.
  14. Busy worming my way inside Sense8 at the moment. Character development FTW... Oh, and can't wait for Mr Robot to resurface! That 1st episode MUST have been a legitimate "leak" - it's superb.
