Also not that easy, what if the person was forced to e.g wife blikssemed by her husband and fearing for her life, accidental etc cannot be treated same as someone who does the deliberate act. Also, isn't it true that if you wake up 2am in the morning, and there is a pigment challenged brother standing over you with a knife, and you shoot him dead, you will probably go to jail for murder.
