I think it is plausible, so you are now saying that I am a reasonable man?

No, I am saying that you are NOT a reasonable man - its quite simple, I said that a reasonable man would not find BS story believable. What you also don't know, is that the concept of a "Reasonable Man" has been used in law for hundreds of years.

 

It is a phrase frequently used in Criminal Law to denote a hypothetical person in society who exercises average care, skill, and judgment in conduct and who serves as a comparative standard for determining liability.

 

The decision whether an accused is guilty of a given offense might involve the application of an objective test in which the conduct of the accused is compared to that of a "reasonable man" under similar circumstances. When comparing BS to a hypothetical "reasonable man", his conduct comes up short, and is NOT reasonable.

just because you are a sportsman or race a bike doesn't mean you should have to hand in your personality when you sign a contract... I wanted our team to be seen as nice guys that are approachable to the general public and willing to have acouple beers with guys and a chat... It's you guys that gives reason for pros to be sponsored...

It's hard to find a middle ground... After some abuse here I might be forced into buying a milk stout court... They say good for Iron levels and blood and good for testo hence my added consumption...

Imagine a local mtb team that are as stuck up as what team Sky are - they will get a lashing of note.. god forbid that there is a team that actually seem to be having a good time doing what they love. So what if you have a couple of drinks.

I did in my hearing and my approach to try be honest and upfront counted for nothing not even a 6 month reduction nothing... SAIDS actually said because I put my story in the media. I made them look incompetent and they said the case was now personal...

 

Not about doping but to make an example that's all I thought was unfair.. I deserved the pushiment, but I was harshly prosecuted for some wrong reasons... That's all really...

Jinne did you read what he said.....he tried to do the right thing.....and was misguided! or don't you believe him..

Perhaps he did, not saying he didn't, its not what I believe or don't believe that matters. But do you think potential sponsors care.

I am fully aware what concept you are talking about, and hence I think you cannot say that the reasonable man will not believe it....read his previous post....they took it personal because they believed he "showed that they are incompetent" and that is exactly what I thought from the beginning...they are incompetent and this "ban" is because BS showed that somehow....

 

It is childish how they handled it, I believe his story and I am a reasonable man....Out cycling administration in SA is a joke. Look what happened with the Commonwealth games? We FORGOT to send a MTB team and applied late for another?

Nolan = backdated 18mnts.

Brandon = Non Backdated 24mnts

Smimby, my take on this is that Nolan got caught (in 2009?) at a time when public opinions / SAIDS were maybe more lenient towards dopers especially if you could come up with some nice excuse and say sorry.

 

After the Lance Armstrong saga (other controversies) we now have pitchforks & hysteria every time someone gets caught and it is zero tolerance and making examples.

 

I think if Nolan was caught today and not in 2009 he would have gotten the full ban.

At least BS is getting the PR thing right. Open and honest (I think). Sadly it IS performance enhancing and the fellow competitors will not be happy with anything but a watertight case. From a medical point of view: any treatment (even water) has side-effects. In this case I don't think it was wrong to treat or be treated but it WAS wrong to race.
