With us as cyclist vs cars, we always end up at the shortest end but sometimes we get some justice. Last year in March a Fidelity Guards vehicle knocked me over and drove off. But it being Krugersdorp he was quickly stopped by some action menWink. My injuries were bumps, bruises, whiplash and R21k on the  bike etc.The cops were their usual self in handling the case and I started putting pressure on them, ended up with a pitbull of a sergeant handling the case and after 14 months the driver was found guilty and got 6 Months or R3k fine.

So sometimes we win even if it s just a little.Smile

now that he is guilty you can start civil action for damages.
yup!! From FG's as well.......vicarious liability due to its staff members actions in one of their vehicles!!

Thanks, Delgado and Kona for the advice, will get in touch with the lawyer handling my third party and civil claim, as he was battling with them before the guy was found guilty and I gave up with that.

how much would you be claiming from the raf? was once told that they tend to settle most claims under R100000. over that they consider defending it in the high court. am not a lawyer though.

HR, they pay per injury, so for the whiplash I get R.... and for the hip I get R....., etc etc. Nothing for my bikeCry.  It is pretty much how banged up you are, is how much they give. I will only hear in August but the talk is R30K for the whiplash only  and the rest we will see.

 

At least I was lucky after reading about another fatality I guess the fact that I am stil alive makes the $$ seem insignificant.

 

Based on Delgado's advice I have spoken to the Lawyer and he now seems more keen to pursue a civil claim.

Wheelsuck, you highlight one important aspect.  Too many of us who have been involved with similar problems just let go and don't put pressure of the relevant parties which at the end lets the motorists get away with all of this.  If we would make sure this happens after every incident, motorists will learn to take precaution.

ewep was also going to look into a raf claim when he had his accident. What's the latest ewep ?

Fidelity van must be a better target for a lawyer than someone with no job, no licence and no address.

 

If it was hit and run, why dont you use a nice lawyer to knock on their door and have a little "out of court settlement" You could let them know that you will also tell every good soul on the planet what a great company they are oozing empathy. Else take the 30k from the whiplash payout and have a front page add in the Sunday crimes telling the country what t**sers they are (can I use the word t**ser?) just been unbanned and I am trying to take it easy
