oh please! its like most other Bicycle shop in this country, your big mate while you spending money and they receiving, as soon as the wheel turns the story changes. 

 

As far as I am concerned the service given by 90% of cycle shops in this country is a joke!  some of the most arrogant people I have even met in my life are cycle shop owners and works, and I work with High end bankers and traders every day of my life, beleive me I know what arrogant people look like!

 

For the shop to turn around and just dismiss it with a "sorry its not our problem" attitude enough for me to make a decission about them.

Most LBSs is arrogant, rude and have a f-off attitude.

 

Single track  - by law you might not be required to do anything, but YOU know what the right thing is to do - and it is not simply pulling up you shoulders and saying sorry. 

 

Damm dude the guy trusted you with his bike! Now it is gone - while it was in your possesion.  You know how crime is in this country YOU should have had better security, YOU should have had a more secure washbay, YOU YOU YOU!

 

In my 8 years of cycling I have only dealt with 1 compatent LBS, 1.

 

LBSs improve your game or ship out!

I have to defend Singletrack on this point. Two more friendly helpfull guys in Bennie and Hannes you cannot find. They have helped me out on several occasions - even as far as loaning me a Lefty and a front wheel for several weeks. I understand the frustrations of all involved but this is one of the better bike shops around.

1)      Claim from your insurance for that value that you insured the bike.

2)      Then you go to the small claims court and claim for the balance that your replacement bike has cost you.

I did this 2 years ago and won. My case was similar to yours and the judge?s ruling was that due to the shop negligence they were responsible for the loss that I had incurred.

Have to agree...... this sounds like the right thing to do.

Clap Best plan so far - and maybe Single Track will be be sinsible too and not wait for a claim from you before offering to help with the balance .

I will speak to them first this afternoon and then look at the options available.

 

 

 

I assume this means I have to go and open a case with the police? Do I open a case against them? (legal advice needed on this...) It still means my premium will go up but maybe I can negotiate something with the insurance.

I strongly considered joining the club for mountain bike outrides - because they seemed like a bunch of really nice guys, always very friendly the couple of times I popped into the shop and the fact that they get good numbers on their outrides also reflect positively on them.

Like you said first try and go the civl route, chat to them and see what they can bring to the table, It should be at least the difference between the insurance payout and actual price of the bike. (at a minimum). If you dont come right then yes take them to small claims court you have nothing to loose you can only gain. And the time it will take the owners to go and appear in court is normally so irretating that it would simply be easier and more conveniant to settle. And as a company they should be insured against this regardless of what they sated in their letter. If they are not, they should simply come to the party. I guaruntee you if the owners car was stolen while being serviced he would be taking them to court if he did not get paid out.

And it should be a fairly simple case, the fact that there was no supervision while the bike was vulnerable to theft by default implies negligence on the companies behalf. So it should be easily sorted out.

Bike shops ae supposed to take your money with that I dont have a problem with, I have a problem when they take your property loose it due to negligence and then just shrug their shoulders. Now that p1ss3s me off totally.

Dude(s) , You lost a five year old bike, which was probably worth R6000 at best, now you want the shop to pay the difference between R10k and R20k, which is the difference between your settlement and the price of a new bike.

Get real , the purpose of insurance is to put you in the same position as before you incurred any losses, which would be to give you a five year old bike worth about R6k - Anything better than that and you scored big time!

 

As for the increase in premiums, if you don't intend claiming ever, because your premiums will go up, why the hell do you even bother with insurance.

My MTB is 4 years old and is showing it... I wish I were as lucky as you as my bike insured for replacement value - I would have to pay in alittle bit and get a brand new bike.

This is one of the better LBSs around...period.

I have had someone drop a can of oil on my car at a dealer - moerse dent and what did they do - NOTHING (referred me to my job card)
I have two friends who have had Polars "lost" by a LBS - a shrug of the shoulder and "I am sure you have collected it" was all they got.

 

Stop dissing the shop, take the settlement, buy a new bike and get on with your life.

I`ve never dealt with Singletrack before - only heard good things.

 

However - "Dont judge a man by the mistakes that he makes but rather by the measures that he takes to rectify them" - My theory.

 

Singletrack - At least show some interest to help resolve this - in the name of all this cycling related

Every bike insurance company will give you replacement value not market value. That is why the premiums are so high.

And think your also slightly missing the point here, you dont have insurance to cover your bike going to the bike shop, you have insurance incase you get robbed.
