Johannesburg - The ANC filed an application for leave to appeal against the ban on the controversial song Dubul' iBhunu (shoot the Boer), the Sunday Independent reported.

 

The ANC said it formed part of the history of its liberation struggle and was still sung by its supporters, the newspaper reported.

 

This application was made on behalf of the ANC by deputy secretary general, Thandi Modise, before the South Gauteng High Court.

 

"I respectfully submit that judicial notice can be taken of the fact that the song in question is known and sung by literally tens of thousands of South Africans. The consequences of a violation of this order are self-evidently prejudicial," Modise said.

 

She said the song formed part of the "history of the ANC's struggle for liberation," the newspaper reported.

 

"It is a notorious fact that the song in question has been sung by members and supporters of the ANC in diverse occasions."

 

The application follows a ruling by acting South Gauteng High Court Judge Leon Halgryn, who in March said the singing and publication of the song was "unconstitutional and unlawful" because it satisfied the crime of incitement.

 

The matter would appear before the court on November 29.

"K***er" was part of my proud past, so why can't I sing about it? Joking obviously but when is linking whatever you are doing now to some bull**** from the past going to stop? In doing that you can just about justify anything or barbaric behaviour.

Gunzo, they are "Struggling" because they live in a shack and have 10 kids. Wife and I are thinking of getting ONE, should just be able to support it nicely. They don't have enough food to feed themselves....... and then have 10 kids. Why? "Becuz we get that gavamunt grant!"

Hate speech or any form of expression inciting hatred or violence, particularly when based on race, is unconstitutional. If the ANC is really throwing their weight behind allowing for the singing of this puerile song, they should be dragged over the coals for it until they shut up about it.

The right to freedom of expression, which can be regarded as one of the essential foundations of a democratic society, is one of the fundamental rights entrenched in the Bill of Rights.

 

Section 16 provides that

 

(1) Everyone has the right to freedom of expression, which includes -

 

(a) freedom of the press and other media;

 

( freedom to receive or impart information or ideas;

 

© freedom of artistic creativity; and

 

(d) academic freedom and freedom of scientific research.

 

(2) The right in subsection (1) does not extend to -

 

(a) propaganda for war;

 

( incitement of imminent violence; or

 

© advocacy of hatred that is based on race, ethnicity, gender or religion, and that constitutes incitement to cause harm.

This proves the point.

We used to have aparthied, back in the day.

Now we have racism, the blacks are racists and even though whites , indians and coloureds are trying their very best to be more liberal and are being very careful not to "put and offending foot" wrong, we are being walked all over.

The attitude stinks and is one sided, their is no striving towards unity and equal rights, no but what we have here is freedom of speech ONLY FOR THE MAJORITY, it's quite sad and a joke actually, kind of reminds me of those slapgat moffies at school who could only pick a fight when they were in a group.

I have said it before and I will say it again, to be able to move forward you need to let go of the past.

So true. Heard many incidents where a black has been reprimanded for doig wrong. Then they scream "You're a racist!" Its like their "get out of jail card". You can do anything do them, if you do, you're a racists!

Kinda reminds how rife the KKK were in the south, the difference here in S.A. is that they have abandoned their veils and tall hats for pantsula hats and 7 series beemers.

The thing is we are trampled under foot every day. Take the example of Taxi Drivers....they are lawless and unforgiving in their attitude towards everyone else...we were almost taken out on saturday by one that wanted to pick up 1 passenger and jumped the red traffic light..almost writing our car off & all he did was put his hand up to say: "I'm soooorrryy" so I said what I did & used the K word ... standing right next to him.

 

We are required to be tolerable with them but there ugly ways are so deeply rooted in society, they believe they owed everything and that they can take as they please ...

 

I keep them at arms length ... I've been called racist...so what !! I have good reason !!!

Correction, those things aren't past time avtivities, that is how they practice their CULTURE (a good word to use as an excuse to practice lawlessness), the national past time is hatred and racism towards the minority ;)
