What on Earth made Cycle Lab even think that using a picture of her would boost sales?

I scheme they didn't, she is one of those snapshot poppers' like on holiday, every time you take a photo of a building some oke pops his head in the picture.

Who is she...?!

She used to present Top billing ages ago. Think she married some successful businessman and didn't they emigrate to the US? (not in the mood to google who's who.)

Gotto have "Model Release Forms" signed if you use any pic of a person for commercial purposes. Usually there are royalties of some sort attached depending on the period of usage: 3-months, 6-months, 1-year. For example, a Voice Over artist reading an ad will get paid a once-off performance fee for the actual recording, but makes his real money from the number of times the ad is flighted during the usage period. And heaven help the ad agency that carries on using it after the expiry date.

Healy says the court’s decision is consistent with earlier decisions that it is unlawful to use, without consent, a famous personality’s image in advertisements.

Ends.

Why was the use of her picture unlawful then?

Just goes to show how much some know about Bassie, she co-owns the most popular tv show "Top Billing" and is a successful business women. Cyclelab wanted to pull the black market into cycling hence they assumed her pic would help as she is a known public figure amongst the black market period.

A simple request from her might have been all that was needed instead of "am" marketing by Cyclelab has caused this mess.
