I find it hard to see that the seller would t have seen the wear marks on the stanchion IF the marsh guard was taken off or at least have noticed some sort of wear and tear.

But I also can't believe that if you pick up an item that you have just bought and find that kinda damage you would not immediately have been on the blower asking questions. Instead you waited 9 months. We all have busy hectic lives but surely somewhere in the first day or so you could of given the seller a call and questioned him.

Even as a seller you put yourself at risk selling items to people who have not seen them for numerous reasons.I suppose if you don't have integrity or value your hubs reputation then it's easy. I sold carbon road pedals to guy in Durban, friend delivered,he inspected and bought them. 1wk plus later problem. Send back to jhb no issues inspected by lbs ,buyer then wants to take them back. Said no refunded him and sold to happy new buyer.

There is risks for both buyer and seller!

It's about your personal integrity .

Morning gents,

Thanks again for all the comments.

Don't have much time this morning, but for all the popcorn fans out there (that has been quite amusing, thanks), here are some more pics for the jury to consider. I promised one of Dave's beautiful handiwork, but there are a couple more of the fork wear more or less as it would have appeared to the seller. As I've been at pains to point out, this bike has seen nothing but a bit of tarmac since purchase. And of that, quite a bit in the 'locked' position because it's a pain to have a fork with that much travel bouncing up and down and dissipating pedaling energy. You can judge for yourself if you would have noticed that as the seller.

Steve, I did rate Mr Mann - thanks for the suggestion. I'm guessing this is not foolproof though as one can just create a new pseudonym under a different email address?

Cheers,

Sam

Hi Skylark,

In an ideal world, a mistake was made (whether intentionally or not) and the correct protocol would be to reverse that mistake (ie the sale).

But we're not living in an ideal world, and I erred by not contacting the seller sooner. So the compromise I suggested to Mr Mann (as in my initial post) was that he cover the expense of the recent service, as some form of acknowledgement of his error and some justice towards me. This was an amount of R900. It obviously won't solve the problem, but it would give the fork a little more life.

I feel this was a reasonable offer. He didn't bother to respond.

don't know who is right or wrong in this case, but anyone buying an expensive item long distance without personally inspecting it (or having someone knowledgeable you trust inspect it), is looking for sh it.

Comes down to the individuals involved.

I've had many long distance dealings where we've often agreed to a deposit, and balance on receipt of goods in said condition.

If unhappy, goods are returned immediately and deposit reimbursed.

sweet bike, glad to hear you're back riding.

There is no foolproof system, infact the hub marketplace works quite well if you compared it to the gumtree free for all as a closest approximation.

Some guys won't touch a seller with low posts, so if you build up a good reputation then you have a wider audience.

That's your ideal world, not necessarily someone else's. Many have disagreed with you here. In their ideal world, you expect too much?

Bought 2nd-hand in November, complaint made in April - how did this thread get past the 3rd post?

Too much sense of entitlement from the OP IMO.
