If you buy off the HUB, please note that it's not an auction site. If a seller advertises and someone gets in before you, don't try to secure the item by offering a higher price. The seller set a price, the buyer accepted. Case closed. If another person then offers the seller a higher price, it places the seller in a very awkward position, and is totally unfair on the buyer. Otherwise, set up a section for auctions, and then we all know where we stand.

Think you and I saw the same ad and response. Fortunately the seller stuck to "the way things work here" and sold to the first interested party.

I had an experience where the seller decided to sell to someone because he was closer and could arrange to see the item before I had already arranged to see it. The seller messaged me after confirming the sale that he had decided to give an option to someone who could see him sooner.

 

I think if this is your MO then you need to state that the item will go to the first person who pays the money.

No real issue with this, but I agree that it must be stated up front.

I had one last week, posted on the advert that I will buy the item. Seller messaged me saying it's still available. It took me 8 mins to reply to his message in which time he sold the item to someone else

I have just dusted down my copy of our constitution and scanned the law reports.

 

Nowhere could I find mention that the Law of TheHub supercedes the Law of Contract as it was taught when I was at Varsity.

 

It is simple, either you have a contract or you do not. If you do, you can and should enforce your rights. If you do not, you have no rights or obligations and can do as you wish.

 

So, in the wise words of Prof Harry Callahan, "do you have a contract or not. Well, do you, punk"

Have changed my mind about my reply to Martinpe. I actually don't think it should go to the first person to put money in. This leads to all sorts of problems like 2 people paying at the same time, and then one of them has to try and get his money back (if it is electronically paid, of course).

 

If a buyer commits, you are obliged to work with him AT THE PRICE AGREED, until the sale is done.

And I think (but I'm not a lawyer) that a verbal offer and acceptance is a contract :thumbup:

If is, as long as the other requirements for a contract are in place.

Gotta love buying and selling on thehub - so many stereotypes.

 

The low baller: Regardless of asking price he/she will offer you 40% with a "that's all I can afford" disclaimer.

The pressure low baller: Same as above but adds "I have cash" and "Offer ends tonight".

The ultimate low baller: Will arrange to meet to see item then offer you 50% of asking price whilst flashing cash under your nose.

The info seeker: Will ask around 200 questions then tell you his mate can get it cheaper.

The reverser: Will ask 100 questions then will try and sell you a product similar to the one you're trying to sell.

The dibber: Throws in "DIBS" then disappears off the face of the planet.

The "seller": Will place an advert then never respond to any for of communication.

The cock teaser: Will advertise item only to realise he has lowballed himself then readvertise the same item at 30% more 2 days later (with the same pictures so everyone can start a Friday thread about him/her).

I agree, especially if you have arranged to meet with the person the same day.

Selling on the hub is tricky business, so I have made up my own set of personal rules:

 

  • If someone says they will definitely take the item at the agreed price, but would like to meet 2 or 3 days later I will hold on to the item for them. If someone says lets meet and see, no deal is in place.
  • In the 2nd instance above, if I get another offer with someone paying the same day or committing to the price, I will sell to the second person.
  • GOLDEN RULE - no sale is done before I don't have the cash in hand or in my bank account.

There are always exceptions where people agree to meet you and pay you your price only to reply an hour later to tell you they bought it from someone else at a cheaper price.

 

No 2 sales are the same...

You missed one: The lazy "seller": Never removes or updates ads after the item has sold.
