Potholes: Can you claim from the council/municipality?

In this country if you're buying a bicycle before you buy medical aid you need to have a chat with yourself or a visit to a state hospital for a look see.

Never said I could afford a bicycle either :whistling:  :eek: thankfully my company contributes to medical aid, but I have been a number of years without it...

 

My sister in law is a paramedic and she reckons that in some cases the state hospitals are better...and yes I have been to a state hospital before.

 

My experience with private hospitals is that the doctors are lazy, overpaid and not prepared to rush...

 

But that is another topic all by itself.

Slight necro, but on topic.

So I buckled a rim yesterday morning on my way to work in the car - jhb central is pitch dark and between all the rubble, oil, patches and what not on the road, the pothole was never seen, only felt, horribly.
I've decided to claim the wheel alignment and rim repair back from JRA. I'll leave for work early tomorrow like 4 am and check along the route for the pothole.
At the same time, I'm going to try institute a claim for a conti gp4 tyre that was slashed from a manhole without cover, which is still open to this day.

I see there are 2 emails on the JRA website, but i also read from the hub and other sources that payouts can take around 3 months, if not more. Does anyone have advice or a contact to keep the ball rolling once I submit everything tomorrow?

Must admit that there's a perverse interest that keeps one reading thru some threads - the imbalance of pessimists and optimists - those who have good reasons why things won't work, or can't be done - then there's those who confirm that it can be done, 'cause they've done it..........

What is so scary is how many of these things are being paid out.

 

We pay taxes for the road to be maintained. But instead, they are paying for damages to our vehicles caused by their roads that are not being maintained

It's going to take time. 

 

You just need to get in touch with the person handling the claim and harass them - constant phone calls and emails. It's the only way.

Ah, right! Thanks Odinson. I read your response on page 1 and was hoping there were exact names, but this still helps :)

My understanding is to do this: submit claims, phone for receipts, ask for agent handling, ask for direct number, phone every 2nd or 3rd day, report back findings to bikehub :clap:

Well over a year later and I still can't get the 10k the municipality owes me after the sale of my house..I would say your chance of claiming for a pothole are zero to none

Are we claiming from the same entity? JRA and municipality?

 

edit: still sucks to hear they're non compliant, whether the same entity or not

That's just the municipality... And from my research it appears to be any municipality in the country

Is it true that you can only claim if the pothole has already been reported to the council ??

 

The reasoning being that the council cannot be accountable for something they are not aware of , however if it has been reported , then they are aware of it and have a responsibility to fix it .

 

This was exactly their defense when I broke a mag wheel and tyre many years ago. It went no further. I couldn't believe it but that's their story.
