Knocked over - what i need to know and do

After years of occasional commuting, got knocked down in Sandton today.

 

 

The chap was on his phone... or just about to answer his phone as he claims. I have two witnesses that stopped to help that can collaborate it was him who was reckless in Sandton traffic.

 

My bike back was ridden over, wheel bent, cassette damages rear derailer, truaxle

 

Possibly the brakes, at the back.

 

I don’t know on the frame.

Bike was rather new ( 3 month or so) spark 940 2017.

 

My rudy glasses broke, helm took a knock.

 

Now i would obviously want a full payout from insurance as i just don’t trust the frame anymore now that its been knocked. How do i go about? Can i insist on full payout or at least frame replacement.

 

My personal damages, bruised and hand is painfull. Getting x-ray tomorrow

if you have insurance contact them for advice on how to proceed just fyi- your bike is toast - don't try make it sound repairable all you say is its a rightoff.

 

(if you don't have insurance brace yourself because by tomorrow he will decide it wasn't his fault and you will need an attorney and that's going to cost $$)

 

firstly however you need  to go to police and report the accident including witness details and damages (wrecked bike/phone /helmet/glasses/ /trousers /whatever )and possible injuries etc-  do it quick before he puts his story to the cops before you do (you need a case number for insurance/ lawyer)

Submit an accident report at the police station, complete with his details as the other driver if you have them. Just numberplate is required. Log a claim against your insurer, give them the case number and then they will liaise with his insurer to settle. You will have to wait a while for the excess to be settled by him. May result in a civil case, fought by your insurer on your behalf and using accident report and witness testimony.

Make a case with the police.

If you are insured, put in a claim with your insurance.

If you are not insured then you will have to put in a claim against the drivers insurance.  This will take quite long unfortunately and expect to put up a bit of a fight.  Could take up to a year to get paid out.

 

Consider seeing someone icw a RAF claim.

If you have his and the witness' details make him pay

Have nr and names of him and witness

Have pictures of him his car, lic and car lic

 

But he drives a citi golf, with a value close to my bike. So doubt he has money

It is insured and already told them its toast want pay out... they asked for assessment, took to cycle lab and explained same to them. Awaiting a assessment
