Can I sue?

RAF will only pay if a motor vehicle was involved.

 

There was a case in Cape Town where a roadie sued the council, when he crashed into a ditch at the side of the road (at the 4 way stop at the Contermanskloof Vissershok crossing) Roadie lost the case.

If I remember correctly that case was settled out of court :blink:

Heres pictures of it. You cant see it from 10m away, it just looks like the road is going on. its about half a meter deep

 

The RAF only compensates where a car is involved - at least thats how it used to be.

 

This is not a public road and no car involved.

 

The ditch looks like soil erosion. If it's Gauteng - then you should have been exepcting it. You didnt have to brake - just bunnyhop over it or at least raise your front wheel. You were on a MTB riding off road.

 

If it was a commuter cycle track and maintained by the city then you may have a claim against them because they failed to maintain the path. It would be a bit like the missing man hole cover on the pavement situation.

 

all in I think you have little or no prospect of claiming anything from anybody.

Perhaps rather spend your time learning to bunny or J hop, I don't think you will come right with the RAF. I also had some bad falls on my MTB, it's part of the game and a risk you're taking when you start with MTB'ing.

 

Sorry to hear about your fall though. I think the most of us, especially MTB'ers, have been there.

It surely wasn't my own fault

I couldn't bring my bike to a grinding halt

 

Instead I flew as if by magic

The broken bits were truly tragic

 

I should have done a bunny hop

But sadly I rolled ass over top

 

Now I feel I need someone to blame

Cos my eyes and skills were too damn lame

 

Free money will mend my skin and bone

But who will see my sins atoned....

One has to love the hub! :)

 

If someone has dug a hole, even on private land and you fall into it, they are responsible for it. Even if you are tresspassing, Someone has to be responsible in this case.

 

So, if i would hear cries for help on my farm, all I have to do to avoid problems is to finish the fellow and sell bicycle on the hub? shocking...

Just fill the hole in, no one will know. Maybe rather sell on The Gumtree.

This reminds me of the caller to Cape Talk. She was walking her dog on Table Mountain when the dog got bitten by a puff adder. She took the dog to a vet, but the dog died. Her question to John Matham was: Who should she sue to recover the vets cost, the Council or National Parks. Matham struggled to keep to keep a straight face (voice?) and asked the controller to play adds. Next call was from a gent who said he was walking along the beach, when a bigger than normal wave came and ruined his pair of Guicci's, who does Matham think can he sue?
