Scott Genius Dual Suspension - Broken Frame

On the 13th of April I fell over and broke my frame. Please see picture. I contacted insurance and raised a claim, the claim was rejected after the frame was sent for forensic testing. The tests revealed more than one crack and they reckon it is metal fatigue, and that I should contact the supplier for warrentee purposes. I bought the MTB in June 2011 and it has ONLY done 598km. The gaurentee is for three years which from date of purchase is within the time frame however it is a 2009 bike and I bought it new from a cycle dealer...

What are the chances of a successful claim from the supplier? My LBS have sent it to the supplier but it has been two weeks with no answer saying it is being investigated...

How do I persue this succesfully? The point is I need to get back on my bike, I really only started riding it in about March and loved it! What a bummer!

Anyone had an experience like this before?

How high is your seat post? How much is still in the frame?

Don't worry. Scout have replaced a few frame parts and a whole bike for me before....funny you say three years as my bike was covered for 5 years back in the day.

If the local boys are not playing game and looking after your best interest, then drop me a pm, and I will forward you the details of the person at Scott head office who assisted me.

I also found going direct vs through the lbs, I got far better service at a shorter lead time.

Hey

I am an Engineer, specialized in Manufacturing, mainly plastic, composite and ferrous metals. The only thing you need to do is prove your seat post was in far enough. The weld HAZ( heat affected zone), is where the failure happened, this is actually a failure in the annealling process post welding. Not enough time to remove the internal stresses generated by the weld.

The crack can be presenting as fatigue, to an untrained eye, because it does have the shape characteristics of a fatigue failure but specific point of origin typical of fatigue.

Either way this is a manufacturing failure... if you need more insight, I am happy to help.

Bad luck, I recently cracked a frame as well - luckily I got sorted out superfast!

I have two questions though - did you have the seatpost in deep enough and did you buy the bike brand new? If you did not your chances of a getting a replacement frame are very slim, as the warranty on the frame only covers the original owner...

Hey guys.

Some awesome knowldge that comes out of the hub! I like it. Seat post was not too high as it still had three settings left to be heightened to. And I also bought it new.

Gary Lee, thanks for your assistance, I will be sure to email you! Thanks a million man!
