Outsurance sues cyclist

So a cyclist is cycling down a parking lot and a guy in his car reverses out infront of the cyclist, the cyclist had nowhere to go but to hit the car. Ok, back window broken and a small dent on the boot. Two months down the line the cyclist receives a letter from Outsurance to pay R16K + for the damages caused. Reasons: the cyclist was in the wrong as he should have avoided the reversing car. After calling the number on the letter it was said that the driver said he was stationary and the cyclist rode into the back of the vechile. I said but he was reversing out and the laywer said that I have to prove that the vechile was moving. My question is how is this possible to sue the cyclist? To prove that the vechile was moving is out of the question so what remains is for the cyclist to just fork out the money. When has the law changed in favour of the driver? Any advise?

Surely if you kick and scream enough they will pay you out and you can go wherever you want?

I sincerely hope so for the Outsurance customers, I don't have that problem with mine...

They Changed it now, Because when i phoned them and asked if they will pay me out the money, because i can def get a better deal at another lbs or online, they said no ways. They pay the money into your nearest Cyclelab's Account and then they will give you a replacement bike.

 

and we all know cycle lab are a rip!!!

All I know is that the cyclist confirmed going to see a lawyer this morning to seek advise on the steps. He is pulling the police dossier before he goes so that everything is on the table. Well I hope it is resolved asap on his behalf

I'm a cyclist yes but not the one in question. Hence the reason asking for advice on 'If this was me - what is the least pain full procedure to follow'. So I got the answer in page one. Thx.

Surely if you kick and scream enough they will pay you out and you can go wherever you want?

My argument was this was my first claim in almost 10 years (house and car also insured with them) and my LBS was closer than my nearest Cycle Lab and my LBS would give me a better deal than Cycle Lab would.

Question for the guys who were told to go to Cyclelab. Did you specify a specific bike (brand, model, components), or just a specific value (don't know if you can do that)? I will be very unhappy if Outsurance does not replace exactly what I insured!

Cycle Lab asked how much I had and then said I would still have to pay in.

I still had to pay in at my LBS but scored a 2011 Trance X1 for a few pennies more.

 

I think I had the choice of a couple of Merida HT's or something at cyclelab.

Im with discovery insure

have 4 bikes on there 2 x road 2 x mtb

with a max insure of 55k

for R200 a month.

 

And as they are new people are always scared of trusting them but the claim process was flawless,

 

2 weeks before the 94.7 my rear derailer comes loose as i pull away after stopping at a robot , it comes around and cracks my carbon frame.

 

I go to the lbs, they argue that the gears was incorrectly set(which they did) so its my prob and also cant do warranty claim. Now the frame was cracked at the point where the back wheel clips in, so it can't be repaired at all. Luckily I had the bike insured,

contacted Discovery Insurance on the Monday.

 

Tuesday afternoon the claim was approved, by friday I had the money in my account.

 

But where will I find a large bike and get comfortable with it before the 94.7?.

 

Luckily I managed to get this beauty.

It does not matter how many times you claim as to who they pay the claim too. Read your Policy Schedule and make sure you are happy with the content, you did agree to their terms after all. Independents are monitored by things like the CPA/TCF, Record of Advice and also do not have the PR/Legal resources to try pull these types of stunts, so they need to make it very clear that you understand everything you are agreeing too, its in their interest.

 

The biggie that people forget is that brokers do not actually pay the claims, the insurer does, so for a broker to keep you as a client, he will do his/her utmost to make sure his underwriters pay your claims.

The 94.7 went well. I managed a 2:42, which is awesome compared to my 3:36 last year :)

Outsurance conceded that this was not part of their policy when I originally took insurance with them for the bikes a few years ago. Thats probably why they paid me and not CL!
