So why did it take SOOOO long for them to come back to BS

 

I have a valid suggestion based on what i've learnt here today

Maybe you could mail SAIDS and ask them, you will sleep better.

And what we do here is South Africa has fork oil to do with you.

If you want answers, go and find them.

That's a very good question, and one that AM asked on SS last night too. EDIT (If you read his tone, he was more calling it bullsh1t than asking) Clearly the process takes way too long, as with Impey. Hindsight is 20/20, but perhaps if BS (and this is just a suggestion) pulled out of comp when he applied, he could have gone on SS and other forums and brought this massive delay to light as a frustrated rider wanting to get back to riding and there are these SAIDS people who are stopping him from doing so due to their drawn out proceses. But unfortunately if he does that now it will be with a tainted opinion, not saying that he mustn't as it will be good if this is fixed for other future riders.

I don't think that would have made a difference, because even if he did not compete, he would still get tested, thus the positive out of competition test, same as David George. I think all you can probably do then is to almost "retire", testing will stop, get healthy and then get tested for 6 months before you can come back to compete.

Forgive me for saying so as this has probably been covered in most if not all of these types of threads. The first response from 99% of all athletes who get bust for doping is any one of a multitude of excuses, stories ranging from I didn't know, to it was the steak at so - and - so restaurant. That's the standard response. Hat's off the the very few who just decline the B sample test and fall on their sword, David George is one such athlete.

 

The evidence is clear, the very long line of past and present is there for all of us to see, loads of pro athletes dope, most of the dopers take every medical and other precaution to avoid getting caught, plenty of them are on a substance that has no test to detect it as yet.

 

My question to the fans and family of the pro athletes is, when are you going to take your heads out of the sand and accept the fact that there is every possibility that your hero is a cheat?

 

As a pro athlete sitting in front of a doctor who is prescribing medication you simply say, " I am a pro athlete who needs to be careful of taking banned drugs, what's in these pills/whatever? If the doctor does not know then get a new doctor. If the drugs are unavoidable and contain a no-no, get a TUE filled in by the doctor and wait a few days for exemption, it really is that simple.

 

Now let's get back to the Vuelta and may the best doper win!

 

A once much loved cyclist stood in front of a large crowd in the middle of Paris and said "I'm sorry if you do not believe.." Well I believe, I believe most of them do drugs, that way I'm not too disappointed when they get done. Which reminds me, what's happening to Daryl's case?

Mine took a week. Granted it was a different sport but done through that sports governing body, maybe cycling SA is just useless, maybe the process has changed, I am no longer a competitive anything so I don't know how it works these days. However I doubt that it takes a long time, Chris Froome didn't have to wait too long for his TUE for asthma medication. Maybe ZA is behind the game.

 

What did take a long time was the hearing, that may be because the athlete delayed for legal reasons? One thing is evident, we may never know the whole truth. What we do know is that he used a banned substance that he should have known was a no-no. These days you need to be pretty creative with how that stuff got into the system. A certain steakhouse in China may be a starting point depending on the substance :whistling: It may explain the delay behind Daryl Impey's hearing.

From your own mail it is apparent that you knew that Anique did not have the requisite authority to grant you a TUE, that you knew it was dependent upon another person or group of persons. Given this knowledge, you cannot rely upon a claimed "mention" from Anique that you may proceed with a banned treatment particularly as you were fully aware that Anique had not reviewed the merits of your application. On your own version, your entire argument that you believed you had permission is based upon a few verbal utterances by yourself telephonically to a person you knew did not have the authority to make the decision. Is it perhaps clearer why your representations to SAIDS were unsuccessful? So you attack SAIDS and wonder why they are unsympathetic to your plight?

 

Ah, but have you considered that she may have had Ostensible Authority? Brandon is not a lawyer, and he did not (and should be expected to) analyze her powers at SAIDS with the benefit of your legal training.

 

 

In Brandon's mind, Anique was the person at SAIDS who is responsible for the issue of TUES. Ergo - she was the bees knees on all matters TUE as far as he was concerned. He acted on what she told him, attaching the weight of her position to what she said. She never responded to his email. She never placed her authority in dispute. So - the argument goes - SAIDS are estopped from denying her authority.
