huur gaat voor koop:

'the effect of “huur gaat voor koop” is that the Purchaser is bound to the lease agreement and the Lessee is entitled to remain in occupation in accordance with the terms thereof. The Purchaser cannot plead ignorance and the right of the Lessee is stronger than the right of ownership of the Purchaser regardless of whether the Purchaser had notice of the existence or the terms of the lease.'

Either you did not do your due diligence when you bought the property or you were mislead by the seller or his agent. Neither of which is the tenants problem.

As for keeping rhino in a mountain bike park, perhaps ask SANParks for their comments, after all it is their our rhino that you have offered to look after.

Huur gaat voor koop is not always relevant in sale in execution, the liquidator can elect to sell with ot without the lease. Nit sure what the case was here.

Ladies and Gentlemen,

Got a request today from Hero's ill informed lawyers, that I am to recapture the Conservancy's rhino and place them back into their small boma so that the mountain bikers can enjoy an uninterrupted ride on the red route. Please help me with this one?

1. Would real mountain bikers not prefer to ride amongst rhino in a reserve on the urban edge of Jhbg?

2. We are attempting to create a rhino sanctuary by relocating 5 rhino out of the Kruger area where we are losing one a month, to this safe haven here in the Cradle Moon. Would you not say this is a noble effort or should Hero get their way and we put the rhino back in cages? Are most mountain bikers not conservationists at heart?

3. The rhino were relocated to Aloe ridge and now only as we create the open area are they able to roam over more properties, including the red route, properties that we bought on an auction of a liquidated estate, with no mention of any claim to mountain biking whatsoever.

You guys figure out just who the baddy is in all of this and one day when you come out from behind the pseudonyms, give me a shout.

Thanks

ANDY DOTT

Good day Andy,

1. Would real mountain bikers not prefer to ride amongst rhino in a reserve on the urban edge of Jhbg? - Fark NOO! Any real mountainbiker, who loves nature, will KNOW that you dont mix wild 2t animals and cyclist/hikers/bird watchers. From this question of yours I can pretty safely assume YOU don't know eral mountain bikers, and 2, I want to see YOU ride with a pissed of Rhino. Maybe the Rhino will do us a favour...

- Yes please do play the "Rhino's are being killed" card - Maybe keep the race card for a bit later?? If YOU cared so much about the Rhino

s, as you proclaim to portray, why would you endanger them by having them moved to an active cycling route, where inevitably they will injure someone, and them have to be "put down" in order to "safe guard" the experience for future customers. LEAVE THE FARKING RHINO's ALONE

All cyclist by nature, and not just mtb's, care about nature, that why we enjoy spending time in the fresh air and nature, and to be clear....again...by Nature i do not mean the 2t gorgeous animal making a  kebab io us...

3. properties that we bought on an auction of a liquidated estate, with no mention of any claim to mountain biking whatsoever.  - So i take it you did not know what you are buying then? did you accidentally press the "But now" button? What happened to due diligence..? Let me tell you what happened Mr.Paving is awesome - you bought a property and KNEW about the agreement, but with your stellar personality you reckoned you can just roll one over on Hero and they will by just to happy to kneel before you. Now that this did not materialize, you are doing everything possible to "evict" them by endangering their clients and trashing their routes. Just a question - ever wondered what liability cover you need for the Rhino killing a cyclist when that head hits the papers? Or when Hero claim loss of income as a direct result of your reckless endangerment?

Do you know why sites use Pseudonyms..? Maybe google it...

Awaiting your sterling response...

Went to heia this weekend. No one from hero adventure was around and a lot of the hero route markings had been removed.

Cradle moon were in the process of putting up there own route markings for an orange and yellow route.

After my ride I was approached by a youngster named Juniour. He is part of the cradle moon. He informed me that hero adventure is now completely out and they orange route will replace the blue route.

What is also strange is the note they still hand out at the gate stating any other fees paid in the conservancy is at own discretion. I assume this is hero adventure fees. Why is it necessary to hand out this note if hero adventure is out.

Maybe Hero adventure can clarify the situation.

Does this mean Hero were forced out in the end? Couldn't keep up with the trail sabotage and the guards bullying riders at the main gate?

What was the condition of the trails like?

The trails are generally very good. Only issue was some missing sign boards so if you have not ridden there before you could get lost.

And then find yourself being gored by a rhino?

Granted all fun and in the spirit of mtb though!

Has anyone been on these trails recently? How have they changed?

I haven't bothered to go back since the management change and the ensuing shitstorm.

As far as I'm concerned, the place no longer exists.

I rode there the previous weekend after a long absence.

The blue has been shortened. The grass is very long and grass is growing over the trail

All hero signs have gone

Red is pretty much the same and in better condition than the blue. Only problem is that the idiots do have rhino on the route as I found out to my surprise when I came around a blind corner.

Yellow is the same route but I don't think that there has been any maintenance since hero left. It was not enjoyable as most the time grass and bush were slapping my arms on the single track.

I will not be returning.
