Here's how it works:-

I am drunk and crash into your car

My insurance declines my claim

You claim from your insurance and gret paid

Your insurance sends me a demand for the amount they've paid you

My car is written off so I owe Wesbank R200 000 & your nice BMW 7 series was written off so I owe R800 000 there.

 

My assets are R100 000 but by now medical aid hasn't paid my claim which was R48 000, my lawyers want their money R52 000 and my house is worth R1m but I owe R680 000 on it and my wife decides to leave me and take half the house which is a major problem because I work for myself from home.

 

I am in the pooh because I drink and drive  ....... don't do it!!

Thanks for the informative comments. Yes, I have been for xrays, was examined by an orthapaedic surgeon and an attorney has already put the wheels in motion for an MVA claim.

 

Just one thing, every body rips off Arnie with his "please wear your helmut" comment every Tues night. After this accident, I've realised that he can't say it enough times. My helmut is in half (that could've been my head), but something I've learned is that all Bell helmuts come with an accident replacement warranty. If the helmut is damaged, you can return it to a shop and get a new one at only 30% of the selling price. That is good service.

All insurers will cover your bike, but in general I think "Mutual and Federal" have one of the better "attitudes" when it comes to paying out this type of claim.

My problem is that I rent at the moment so don't have a personal policy.

 

My personal vehicle is with my business insurance which they(the insurance company) allow because I'm a partner, but they won't cover my bike.

 

I need someone that will cover the bike only

No! There would be no obligation from the 3rd parties insurer to effect any settlement even assuming that he may have been comprehensively insured. Alcohol would be an exclusion under his coverage. The only way his insurance may respond is under a litigation action where you demand/sue for damages and the 3rd party is in posession of personal liability insurance. Here aspects like alcohol are not excluded and all you need to demonstrate is negligence on the 3rd parties behalf having led to your loss.....

Sadly, Cry I referred the dispute with Cyclesure to the Ombudsman, who referred it to the underwriting company, who felt that their assessor knew more about Carbon Fiber and fatigue being the cause of the failure of the carbon, than the structural carbon fiber engineer of the company that manufactures the wheels and who wrote a letter stating that it is the Wheel Manufacturer's assessment that the wheels failed as a result of direct impact, as carbon fiber does not fatigue...

And the Ombudsman accepted the Underwriters siding with the assessor rather than the expert opinion of the Wheel Manufacturer's design structural Carbon Fiber Engineer....

Sad, isnt it Crux.

 

Its much the same in many fields, anytime a regulatory body is staffed by members of the same fraternity (ie)their own peers - you will seldom get a fair and equitable solution.

[/quote'] I am busy investigating an alternative solution for the whole Club, of which about 20 riders insure with Cyclesure...

It's one thing to piss of one small client...

It's a bit bigger if the client can negotiate a better deal for the whole club and lose 20-30 clients, maybe more...
