The seller claimed that the frame had never been in a crash, and that it was fine. I dont think its right to sell something that could prove to be fatal.

GO, if the shop could see the crack when you took it to them, then the seller would've known about it when they stripped the bike down to sell the frame. Also, to have said that it was fine the implication is that the seller had checked it thoroughly which clearly is not the case here. by switching off the phone when you try to call they are indicating an unwillingness to try resolve the matter if it persists. they may, however, be in a meeting if you've just tried once so i understand your choice to not name and shame yet,. but if the matter remains unresolved by tomorrow morning then please do name and shame. when that happens please also state the make of the frame as there may be other hubbers who are interested in said make/frame and as such are interested.

SlowPoke, I agree totally. And I accept that the seller is probably busy at work. In fairness, the phone just went to voicemail. Also, with the SMS that they sent suggesting that I contact the other interested party I just find that unacceptable. I could not sell something on to someone knowing that it was broken. I have been advised that even a purchase under VOETSTOETS circumstances allows me a 7 day "cool off" period, of which I was unaware.

I also want to try resolve this without naming the seller, because they work for a very well respected bike shop.

GreyOwl, you are trying to be far too nice.  The signs are that this guy is ripping you off quite intentionally.  That SMS you got (contradicting his previous offer to refund you), his unwillingness to answer your calls, the fact that he doesn't appear to have the money to refund you (suggesting he's desperate for money).

Don't be a helpless victim here - hit back as hard and as fast as you can.  Set firm deadlines, after which you should lay a charge against the guy at the local police station.  If you don't have enough info about the guy to lay the charge, tell us (the hub) what you know about him and I'm sure someone here can provide more info about him.

Exotic frame... That can only mean one thing - Colnago!

Actually, there was a Look frame advertised here a while back that might qualify as exotic.
