oi, most unfortunate. Pity there are almost hardly any followups on the cause of the accident. I guess when one party is deceased, you can never really determine the real causes, unless reliable witnesses come forward.

"but the driver alleges that the cyclist crossed the roadway unsafely in front of his approaching Toyota before the crash" ... probably while driving in the yellow lane. Or am I being a bit judgemental?

Nope, you are not... People will say all sorts of stuff to get out of trouble... Interesting bit, someone has died, and the driver was not arrested? WTF?

...and sometimes they tell the truth. We can't really tell either way without actually being there.

As cyslists we tend to be very critical of motorists and most think the driver guilty of reckless driving, we want someone to blame. However, we know nothing of the circumstances.

 

In this instance, sadly the cyclist is dead and cannot speak for himself. We have nothing to refute what the driver says and witnesses might confirm or refute his story. Let us not be the judge without knowing the facts. Sometimes cyclists do stupid things that places their own lives in danger, and I speak of experience.

 

When I was 8 years old I crossed a road thinking I could beat a car through an intersection. I was wrong and he probably hit me at 40-60km/h (was a fast road 80-100) I was fortunate with only minor injuries despite going head first into the windscreen. The driver was completely innocent. However, had I passed away would people have thought, stupid kid or stupid driver?
