I'm guessing you didn't have a phone/camera on you whilst riding, and took the shot from the road later.

 

I applaud you for not just shaking your head and letting it go, it is a sad state that this behaviour is not unusual. I'm thinking that despite the general feeling of tow trucking industry, there has to be some with higher moral standards than the rest. Maybe taking the story to the company in case is going to be the best bang for buck in terms of protesting.

Try figure out who the insurance is, they will not pay out if you inform them he was drunk.. Send a message to the big insurance companies with the number plate info..

Teach the prick a lesson.

In South Africa it is standard procedure for a drunk driver to IMMEDIATELY leave the accident scene at ALL COSTS! I am a cop with 20+ years experience and in the last 10 or so years this phenomenon is sadly very very common. It is much much cheaper for the driver to act this way.

Maybe a trial by social media??? perhaps not a bad idea to post your observations & facts on the FB page of the tow truck company...dunno how /what effect that will have though...

Insurance has no way of proving he was drunk. Would be his, the mates and the tow truck drivers word against the cyclist. The horse has bolted on this one unfortunately!

I love the way everybody rallies around this cause.

We need to get these guys off the road. If somebody had been walking or cycling at the time it would have ended with a death yet because it was only a fence and shrubs damaged it's fine. Shocking!!!

Get hold of the owner of DALS, describe the driver and have ameeting with you 3 parties and have him reprimanded bu the boss.

Then start sending the reg number to the various insurances.

Well done on taking this further.

Can still make his life difficult and he is stupid enough to incriminate himself along the way I bet!!!

Not necessarily. They could get a court order to force a tracking company to disclose his whereabouts leading up to the accident, for instance. I was speaking to the owner of my local Keg the other day. He was dealing with an insurance investigator who wanted to see a claimant's bar bill that he rang up prior to him leaving the pub, and any CCTV footage.

Still wouldn't hurt to get the insurance claims adjuster to dig into every little detail of this guy's life, and make it as hard as possible for him before they pay out. With the amount of fraud in the industry currently, they will look for just about any reason to repudiate a claim. Just give them a reason to dig deeper.

Done that, 567 Cape Talk did that for me :mellow: and I have a photo of the Dals driver so he can not say it was not him....Listen to 567 tomorow morning to hear what Dals has to say.....

Still need blood and/or breathaliser (spelling?) - that is what they are there for. Any lawyer worth his salt would get this clown off, he could simply say he was buying his choms drinks. That combined with his testamony and his mates and the truck driver etc would make it very hard for insurance to repudiate claim.

 

That said they do not like paying out so there is a chance of them making his life painful as they pay legal retainers so no skin off their nose by taking it to court to try their luck (bar clown's legal fees should he win).
