car door....

I was cycling from simons town this morning and when I was passing fish hoek.. a car door was suddenly opened.. I was almost passed the car whatever. And I stopped. Fortunately

I didnt fall dowm but stitched instep of my left foot...

Really I was lucky. U can see the car door how sharp is...

Be careful guys..

 

I will go to the police station now now

 

I need some advice what I should do? And was that my fault..?

All my friend say it wasnt but if anyone had this kind of accident, please let me know what I have to do.

Depends on where you're riding. If a motorist opens a door into traffic, its the motorist's fault.

Now u can see the car how she parked... if she wanted get out from the car , she had tp open the door into the road.. I guess.

Eish....eina....hope it heals soon.

 

A similar incident happened to me and the driver paid all my costs.Think she claimed from her insurance and my medical aid paid the hospital account.

So if parked on the side of the road, a motorist must check that it is safe to open the door before opening.

 

Dale has the best suggestion. Rwport it to the cops and ask them who was in the wrong.

Thank u~ I dont have any insurance hahaha but it was R1000 so it's ok..

Just my shoes.. R3800.. handlebar R4000.. duraace front rever (?) Reber (?).. :(

BS! As a pedestrian you must report it to claim road accident fund if injured why would it be any different on a bike.

she will have to get a case number to claim door damage from her insurance

That can't be right. If you follow that logic a car driver can mow fown as many people as they like as long as they dont hit another car.

That was a traffic accident end of.

Your posts are very limited and sorry to say the typing, grammar and spelling is not fantastic, so I'm going to guess the situation:

You were cycling on the left hand side of the lane

There was a stationary vehicle on your left

The driver opened the car door just as you were next to the car

your foot caught the door and bent it to the position it is in now

You have a foot injury and there is damage to your bike

You took down the driver details. (Name, ID, insurance co details, etc.)

The driver is insured and you wish to recover your costs against his/her insurance.

To do this you need to report the matter to SAPS (b.t.w. you have to report this. If you were a pedestrian that got knocked over you would also be within your rights to report this. If the constable on duty refuses to open a case, call for the station commander).

 

Just as a side note: This is why I maintain a meter gap between me and parked cars at all times. Those old farts in Sea Point can hoot all they like.
