Misleading On Line shop advert at Cycle Lab

On Monday the 1 Feb there was an advert on the Cycle Lab On-Line store for a Sram Red Road Kit with an attached picture. Picture showed full drive chain, shifters, rear hub and rims. price was R299.99

I placed an order and paid for the item and received confirmation of order. On Tuesday the 2 Feb I received a call from Cycle Lab On-Line shop to tell me that they were waiting for two pieces of the kit to arrive and the order would probably be dispatched later that day.

Two of my riding friends then each ordered and paid for the same Sram kit on Tuesday. Both of these orders were confirmed.

This morning we all received a call from Cycle Lab On-Line shop to tell us that the kit was actually only the nuts and bolts for a Sram Red kit and not as the picture showed all the components. The picture used in the advert had been incorrectly used to advertise the parts.

Yes, someone messed up, but be honest with yourself here.

Holding them to that price for that kit would just not be right in my opinion.

Pretty sure you guys knew it was too good to be true, but I think Cycle Lab may be obliged to fulfill your order, it was their mistake not yours. I'm no lawyer though.

No, the CPA is a bit iffy on it...

 

Section 23 of the CPA states that if a displayed price contains an inadvertent and obvious error, the supplier is not bound by it, provided they correct the error and take “reasonable steps” to inform consumers who may have been exposed to it.

Would a reasonable man assume that a sram red groupset would sell for R299.99?

No he would not.

 

A person trying to exploit their honest mistake would, using CPA threats to try and get a full SRAM Red kit for R300 come on man.

I dunnow hey, mistakes happen, I agree.

 

But when offering high ticket items, make double sure you have it right.

 

Life is tough, even tougher when mistakes like this happen.

 

Sure, the noble thing would be to rather inform them of their mistake, but I think the CPA is on the OP's side.

It was an error on CL side - simple as that!

 

I'm sure that employee is facing a disciplinary hearing for bringing CL in disrepute :ph34r:

Yoh, we've become a cynical bunch as a community over the years! Unfortunately it's because we've been here long enough to see the stunts some flybys have taken eh! Somehow I tend to agree with you on this one Meez!

Even if they sent out the entire kit as an apology for the mistake, I would never ride again... Karma sometimes works quicker than expected.
