Mongoose! Posted September 23, 2015 Posted September 23, 2015 Wonder if there are any SARS employees on this threat / forum? If looked at some of the replies here (not all) there must be a few CA's here as well.
raptor-22 Posted September 23, 2015 Posted September 23, 2015 Only issue here is shop said they could help him. The are under no obligation to actually help him get a VAT refund. So why do you need a CA ?
KingTJ Posted September 23, 2015 Posted September 23, 2015 Only issue here is shop said they could help him. The are under no obligation to actually help him get a VAT refund. So why do you need a CA ?No CA is required, you say the shop is not obliged to help (which is true to a certain degree). The problem here is, the shop charged VAT on an item illegally. It is only allowed charge VAT if it is registered for VAT. You can only register for if your turnover exceeds R50000 for the 12 month period ( this is voluntary registration) or it becomes compulsory to register when your turnover exceeds R1million. To charge VAT if you are not registered is Fraud amd can have a penalty of imprisonmemt of up to 5 years etc etc. To register for (once you have all your documents ready- and this is what most people struggle with) is fairly simple, all ypu need to do is amle an appointment with Sars (thos can sometimes take up to a month) they will go through all your documemts and maybe come out and see your premises and issue with a VAT number which will allow you to charge VAT. I hope thos makes sense as i have tried to simplify it . N.B. So the shop is obliged to help as it furnished a VAT invoice, which should have allowed the OP to claim Vat when he leaves the country. The right process here would have been for the shop not to charge VAT unless it had started the process of VAT registration. If it did not charge VAT...then the OP would have left without handing in his VAT forms and we would not be having thos conversation.
