So I bought this bike...Unhappiest day of my life.

Appreciate that, but the only thing I expected from anyone was from the bike store to send me a bike that I paid for that's rideable... I know wear and tear as well as the next guy and I never had an issue to replace parts that's only got a few good km's on them... But I have paid for a bike in full 10 days ago that's still hanging on a repair stand because the wheel doesn't fit in the fork.

Dude... that thing's end-caps are an abortion in themselves. That crack in the paint could very well be a cracked frame in that area (seat tube / top tube junction) if the previous owner had the seatpost at full extension... And this is just getting to be a dogshow.

OP doesnt want to name the shop because he knows they dont have a 1000 post and he'll be taken to task by the Hub police. When will they ever learn.

WOW! You are way too nice. Next time buy from someone you can drive to for viewing or get someone close to the buyer to view before any transaction is done. As for the shop owner, he sounds like those characters who sell stolen bikes, you must just keep history of the transaction/ communication in safe place, if he can sell you a bike without brakes, he might as well sell you a stolen bike.

Can't do that with it going legal. Will have to wait for it to be concluded first.

Of course it can, a statement like "this is the bike shop that I am taking action against...." Is fine.

 

That bikeshop that sold fake Pinos was all over Carte Blanche before anything was concluded.

 

Mr Frank whatever who conned our fellow hubber was named, nothing has been concluded.

 

I can go on... :)

This has turned into something way bigger than a bike for me...its about doing the right thing. The fact that I try and look for the good in people has come back to bite me for the last time. I'm taking this now as far as it has to go...or atleast until I'm satisfied with where we are with the process.

Story behind the story is this...As said before I sold my bike as I wanted to get something with a smaller frame... The bike I sold to buy the bike from him was a bike I financed and still paying it off....and he has already reminded me that I was not allowed to sell that bike. Which I'm still not sure if that was a threat as he told me he's an agent for the finance house... or just some general info.

You havent taken a single piece of advice here, changed your mind about second chances and refuse to actually say who this shop is, so I am not sure what it is you want from the Hub. Sympathy? Well that ship has sailed.

I read the initial OP and this is  whole  thing and ensuing debacle is not on. 

Hope you get it sorted and can cycle happily ever after.

OP, when you opened the box, you realised it was not what you paid for.

 

You did not send it back- why not, I don't know!

I'm with you on this one.

Lots of people tried to help and gave some good advice.

I'm sorry about the bike you bought but my sympathy is running low now.

Having good faith in that shop/person got you nowhere.

When you ask for help around here most people are sincere in their efforts to help another hubber out just for you to come back and complain about something else.

As Bloukrans said, open the box and it's not what you paid for, then just send it back. It's quite a simple exercise.

 

But anyway good luck with whichever way this issue turns out

Instead of being a deek about the whole thing you have hoped for an amicable solution, doesn't look likes its going to happen though.
