obviously one can find the owner of the vehicle. . should a case be opened with the police? what can a person be charged with?

They get charged for not wearing seatbelts.... and delaying traffic :huh:

Top of long street? If it wasn't stolen, and he wasn't drunk or doped up, then he probably had a few frowned-upon recreational chemicals in the car and didn't want to wait for the cops to come around. That part of town is under the jurisdiction of the Nigerians anyway.  :ph34r:

So the owner of said car is

The full id number of the registered owner was posted to FB, and the id number was of a woman. So either a family member or the car is stolen.

I really hope that the lack of helmet does not result in a failed prosecution of the car driver.

 

The only reason I wear a helmet is I worry that if I'm in an accident like this, and I'm not wearing, a judge will say I'm reckless cause I'm not wearing. :thumbdown:

the law doesn't require a helmet and really makes no difference to the motorist being at fault

 

anyway the haven't even found the driver or the car yet so what makes you think there will ever be a prosecution ................ :whistling:

I would like to know what the outcome of this is. 

I dont have much faith in our police and traffic cops.

I always easy/soft targets like the avg middle income peeps are who they are they hardest with.

It does. From National Road Traffic Act, Chapter VI, Part II, 207:

 

(2) After expiry of three years from the date of commencement of this regulation, no person shall drive or be a passenger on a pedal cycle on a public road unless he or she is wearing a protective helmet which fits him or her properly and of which the chin straps is properly fastened under the chin.

 

This was enacted in 2000, so the 3 year grace period is long over.

 

Stupid law if you ask me, but still law. :thumbdown:

Yes, logically it should not, but there have been cases in the UK where cyclist involved in accidents where the motorist was at fault, have had "findings of contributory negligence" against the cyclist because the cyclist was not wearing a helmet. Some details of cases here: http://www.cyclistsdefencefund.org.uk/cycle-helmets-and-contributory-negligence/recent-cases I don't know of any precedence in South Africa, but I still worry that it might become the case.

Yes - I'm being optimistic that the driver will be caught.

Yoh! full ID... nice for identity thieves...

 

But if the car wasn't stolen, the owner is still in for the high jump... else they have to prove who was driving. then that person with the passed buck the high jumper.

The law DOES require wearing a helmet in SA- although not wearing one should have no bearing on an incident like this.

Neither of those have relevance to careless driving... stupid, but not directly relevant to the incident- unless it goes to show a pattern of stupid behaviour...
