I think any of us who have ever been injured ever should either sue the big bang or god (whichever way you prefer to believe the universe was created).

I mean, if the universe, and by extension, us and this planet, did not exist, we would never have been hurt.

 

Jeez, if you can't accept you could get hurt, take up stamp collecting - though I bet they'd sue the post office if they got a paper cut...

Hey I broke my wrist a year ago at thaba when I fell off my bike. Had a front tyre burp. Wonder if I can sue continental as the tyres don't hold the air in. To make it worse I have a semi permanent condom on my middle finger because of latex sealant. Shyte I'm going after stans too!

 

When do the yanks learn. Sh¡t happens and you get hurt when it does.

next thing we can sue Nissan because the red on my Trailseeker socks faded after 3 washes....

WTB were sued for millions because a tyre rolled off a rim resulting in serious injury. So now the tolerances on theirs rims and tyres are the best in the industry and the reason why you can inflate and seal their tubeless so easily.

So signing a waiver means nothing?

A waiver can't deny you your common law rights but if properly worded it formally advises you of the risks of the activities you choose to undertake.

 

I suffered similar injuries to the same vertebrae in a non sport related fall 4 yr ago. Very unpleasant and it took about 2 years to be free of continuous pain. I have sympathy for the injury she suffered but attempting to blame others for it is a bit ridiculous. Sometimes we do things that cause us a serious setback in life and must take responsibility for it ourselves.

Indeed, the threat of serious litigation keeps manufacturers, service providers and the like on their toes, keeps standards high and all "I's dotted and "T's crossed, I have no issue with this, and in my opinion its a good thing. Unfortunately, unlike the US, South African courts apply little value to loss or pain and suffering.

Article says it was a pre-ride before a race. If one of us riding a race, came around a fast corner and smacked head-first into a fallen tree, or came off a jump and landed on an object in the middle of the trail that should not have been there, we'd also be angry enough to want to sue etc. If it was not an organised race, then it would be a different story, of course. I'd assume that the case would centre around whether said log was a built up ramp, or a fallen tree that should have been removed but wasn't.

The article indicates it was built into a jump.
