Your justification for the SAFFA frustration is exactly the reason why the cyclist protection legislation needs to be amended to making the motorist immediately culpable when hitting a cyclists or pedestrian.

 

Was in Holland a few years ago. We remarked to our taxi driver that we were amazed at the patience shown by drivers towards cyclists. I was surprised when in response, he told us about this legislation. Didn't know about it at the time.

 

In his mind it forced people to 'think bike' if I can use that term and was the reason why motorists showed such care and patience.

 

If you mention it to motorists locally they all think it's ridiculous and unfair. The law isn't intended to automatically lay blame with the motorists. It just places to burden of proof with the motorist. He has to prove that it wasn't his fault.

 

They need to realise that it's not about apportioning blame, but rather forcing motorists who are in 99% of cases going to walk away unharmed to consider the other party who in 99% of cases will not walk away from the incident and quite possibly lose their life. Problem is South Africans are to f_ing selfish to care.

might be unpopular but the fact that the driver said he swerved might hold a 1% truth. Turns out they were 2 italian triathletes. think they usually drive on the opposite side of the road so perhaps a small lapse in concentration you never know

reckon it's all speculation until they interview the one that is recovering well :). Until then we shouldnt really jump to conclusions even if the Sunday times and the times are reporting it. Very poor journalism on their behalf.

Going downhill feasible but if you are riding uphill surely your concentration lapse is not to cross the road onto oncoming cars?

Your point is totally moot considering the fact the driver has admitted brake failure, as pointed out on this thread earlier

Agree - I understand that the driver tried to avoid the cyclists  after the brakes failed! That means, he was already a loose canon at the time he hit the cyclists.

I've lived in parts of the world that are on the other side of the road and this is basic logic that is just not the same in reality. You adjust VERY quickly to the other side of the road, mainly because it is so damn obvious from traffic patterns. And why would you just sommer cross the white line halfway up a long pass?

 

It looks like these two athletes have travelled enough to have been exposed to this before.

I passed the two ladies at the bottom of the pass while they were still going down, and I was on my way back up. They were cycling single file and on the left hand side of the road. 

 

Can't see why they would not have done the same a short while later while going back up.

Absolutely.

He hit cyclists but it could just as easily been a car, motorbike, taxi or a herd of nomadic nuns. He had lost it already and they were just in the wrong place at the wrong time.

Just shows you how inaccurate most news reports are. The majority of Franshoek crash news reports are baseless, reckless, irresponsible, and cannot be further from the truth and I'm disgusted.

 

I also find it strange that no statements, not even a whisper, was made by either PPA or CSA concerning all these garbage reports concerning this incident? Perhaps this type of news is not part of their mandate or of no concern to them or they are awaiting the report after a full investigation, but then they could have at least said something. This is not an attack on PPA or CSA, i raise the question as i do not know.
