Personally I think that ultimate hubbers from somerset west who point fingers at pros are jealous riders that have tried the route beyond bread and water, failed and are projecting their failures at the pros.

 

Hmmm - did I cover all the bases:

Vague drug reference? Yes.

Not personal but clear enough to make it obvious who I'm talking about? Yes.

Can I be done for defamation? No.

Can I use Lance as a reference to indulge my statement? Sure.

Should I have bothered to say that in the first place? No.

Is it trolling? Pretty much.

Not naming sommeone is no defence in defamation cases. If a court decided that the "right-thinking" man would easily see who you were referring to, damage to reputation could possibly be proven.

No, defamation doesn't have to be a direct accusation. Inference with intent to call a reputation into question also qualifies as being defamatory.

I think it's an identical situation - it's random people who are armed with media reports questioning your integrity.

 

Have you volunteered to be audited by SARS to prove that all your purchases are legal and above board? Have you paid independent auditors to do the same?

 

Yet you expect people who ride bikes for a living to prove to you beyond your level of doubt that they're clean? Why?

 

I don't think media reports are the same as race results. The latter are completely factual. Well, maybe I'm wrong about that but I'm ok with that. I still think its better to be proactive than to be defensive. And if you do get defensive people will draw conclusions. Doesn't make them right, but they do. If you're in the spotlight you need to take that into account.

 

Any way, you're getting a bit carried away. I never said people who ride their bikes have to prove to me they are clean. I said its ok to ask questions and I said if people ask questions its better to be proactive.

There is not allot of credibility or integrity in saying what you want and then back pedalling to 'you can't prove I meant it that way'.

Strangely enough something true can also be defamation. Defamation law is all about affecting one's reputation by stating, or insinuating, something that detracts from the view of that person before the statement was made.

 

Mostly people who are defamed will not take action as their attempt to defend their good name only brings attention to their dastardly deeds, even if they win the action.
