Agh FFS CPA comments already! We aren't kids and always need to run to a "mommy" to help us.

 

A few times when I've lent tubes to strangers on the road, they want to get in contact to give them back, I always tell them, rather than give me tube back, carry it as a spare and give it to the next guy you see struggling.

 

So, Small item, do the right thing, give him a refund, hopefully he is a nice guy and one day does it for someone else when the time comes for him.

Sjoe bud sticky situation. All I can say is I wish there where more guys like you out there. You sound like a genuine guy not looking to screw anyone over. The mere fact that you came here asking advice would make me support your story. Good luck, I hope you come right.

you may have lost one sale, or if you sell these again, you might not get your price. BUT! you have gained a WHOLE lot of integrity, and that is far more valuable.

 

and I think you also answered yourself, you said if you were in your buyers shoes you would also have a *** feeling, so there was the answer on what you should do.

Ive hand a similar issues with those pedals if that in conciliation - strangely also the left. Lots of play and a speaky noise.

Under the Consumer Protection Act.. All goods are sold in a good working condition..

 

And the rules are the 3 Rs, Refund, Replace or Repair..

AFAIK, the CPA is not applicable to individuals, only companies over certain size.

No......it speaks of people who regularly trade. That could be the small corner cafe or a multibillion Rand corporate.

 

It could even apply to hubbers that regularly sell stuff on the hub.

Spoken to buyer and offered him a refund. He's not sure if wants to keep the pedals or not. Awaiting his decision.

If he wants a refund ask for the extra set of cleats back.

I really do admire some of you guys morals. I have been in one or 2 situations regarding 2nd hand equipment that came back, and in both cases I gave a refund. I always test and double check whatever I sell before it leaves, just to make sure it's all good. People have a tendency to break things and then demand a refund saying it was broken. 

 

As you mentioned, the guy seems a gent, so it's all up to you. Hope everything works out for both parties :thumbup:

If it is their major source of income, the act applies. People who regularly trade on the hub will not not fall under the act.

What ever became of the situation?

 

I recently sold an XT derailleur to a gent in KZN, I sold it as a 10spd and silly me never bothered to check as it was supplied to me as a 10spd. Anyway the buyer contacted me to tell me it was in fact a 9spd. I replaced it for him with a brand new 10spd and he shipped the 9spd back and both parties are happy. I felt it was my moral obligation to do this as the parts supplied were incorrect.

 

However your story is slightly different! I would refund the dude, get your extra set of cleats back and resell them :)

Weirdest thing is since I spoke to the guy and offered him his money back,he said he would think about it as he still wanted the pedals he just needed to look for the extra set of cleats and would let me know.

 

That was on the 29 oct,and have not heard from him since,despite me calling him with no response. And I obviously still have the pedals.

 

Sure he will contact me soon.
